A force of 8110 men and a lew num-ber of teams were eiiinmed in plowing np the middle of the street, bediming at the First South street crossing and going south; and these work-men had even succeeded in laying ties and rails on the suaro embraced within the First South and First luist intersection, when Mayor 8cott, acting simply in his capacity of chief magistrate of the city and the guardian of the people's inter-ests, at once ordered the city marshal to put a stop to the work; it not beiiiK apparent to him that the electric company inissessedany franchise covering its right to construct tracks ulong the street thus invaded. Marshal Young thereupon detailed a enfijeient force of policemen to carry out the mayor's or-ders, and the work was consequently brought to a halt. The small piece of track which had been laid next attracted tho attention of the police, and this they tore up. As a matter of course, the mayor's otlice was quickly lieeiceyiil by an anx-ious crowd of electric road olfieials, who were infi rmed that until the company could show evidence of its right to build and construct a track along the Btato roud, no work could bo done. It is stated that the company claim the fran-chise right of building street railway tracks along nay and all of the city's highways under an old ordinance granted it by a former council, and it is to settle this question definitely, one way or the other, tnat the mayor is now acting. It api'rs that the street railway people have virtually waived the privileges they now claim by seeking and obtaining from other councils the right to ex-tend their lines on siiecificd streets, and that one of these applications was made as long ago es 1H7I). At all events they will now bo required to show, in a legitimate manner, that they posses such a franchise as they claim before any mero work can lo done along streets not covered by special ordinance; and even if they do this it is not improlmble Hint the validity of the ordinance which granted the wholesulo proceeding will be tested. THE CLAIMS OF TUK RAILWAY PEOrLK. Mr. A. W. McCune, president of the street rail-way company, said to a Timkh representative: "We are acting under two franchises covering the whole of the one street nnd two blocks of the other. The company proceeded under the advice of its lawyer, who declares that tho franchise is good and legitimate, and will stiuid the test of the courts."
