Show SILVER KING SUIT DISMISSED in connection with the suit recently f hied by the silver king consolidated against the I 1 silver king coalition of park city the sur beyor appointed under direction of the court to survey the workings of the latter t to 0 determine the matter of trespass having filed his report which follows the suit was dismissed J on the motion of plain plaintiff tift the report follows since filing in the above entitled cause J the report of the engineers engaged in be half of plaintiff of the survey of defendants J underground workings the undersigned undersigner under signed re turned to defendants property to complete s the work of investigating and surveying J access was gained to the kala drift by the removal of some of the loose material in the overland the face of the kala drift was found to be feet from the near est line of the plaintiffs property the workings of the kala drift from the point where access was gained as above stated were found to be caved and inaccessible back to a point indicated in the former report on file herein no attempt was made to remove any other portion of the caved material in the workings referred to in the former report than as above stated and it was therefore impossible to determine by actual inspection whether there were any workings leading to or in the direction of plaintiff s property but from all the circumstances and information given me I 1 am of the opinion that no such workings exist other workings lying to the southeaster r ly of and running in the direction of plaintiffs property were also surveyed but it was found that they do not enter plaintiffs ground As a final report upon the matter of in vesti gation I 1 have to say that I 1 found no evidence of the existence of any of the work ings of the defendant entering beneath the surface of the claims owned by the plaintiff and described in the complaint on file herein respectfully submitted FRANK ANDERS ANDERSON |
