Black, attorney for Adolpu Sutro, has been reinforced this weok by ex-congressman Shellaberger, of Ohio, and Wilson, Wil-son, of Indiana, and efforts are being made by this combined force of legal talent to induce Commissioner Bur-dette Bur-dette to decide that all patents for mineral lands or lodes claimed to be branches of the Comstock lode shall contain the Sutro tunnel royalty clause. Vigorous efforts are also made to procure a prompt decision, but the commissioner has promised Senators Jones and Sargent that he will not take any final action until they have been heard, which will probably be tho latter part of this week. Sutro iu making a strong point by filing with the commissioner maps of various mining districts near Virginia and Gold Hill, all of which ahow that the various mining companies at Dayton, Day-ton, Silver city, Flowery district, Devil's Gate and other points, are claimed to be on the Comstock, and with other evidence in addition to what has been prepared specially by , Sutro's agents, he claims that the department de-partment cannot avoid bringing them under the provisions cf his act. |
