Pitkin gave a detailed story of the caucus of the' McVeagh com mission and Packard , legislators which he had received from j a member of the Packard legislature. At that conference, alter a good deal ol discusfcion, McVeagh aaid: "It you want to 6ght you can do it, but on next Tuesday the troops will be withdrawn, with-drawn, and as the courts are in the hands of tue democrats, you will all be hung up to the lamp poets." The next morning the Packard legislature was virtually disbanded. Witness was prepared with papers, newspaper clippings, and the like. Butler himself him-self had a scrap book in hia band which contained a number of clippings from newspapers relating to the McVeagh commission and its wtrk while in New Orleans. One of these statements by Duprees, manager man-ager of the New Orleans Democrat, to the efiect that three members of the Packard legislature, who had gone over to the NicholU' body in order to make a quorum, bad been heavily bribed by a lottery company in the ii terests of the democratic party. Tne witness said Swarzey told him that General Harlan also exhibited great petulanceduring the conference relerred to, and said the commission had been down there about ob long as they wanted to stay, and this thing must be fixed up. After recess Roger C. Glasscock testified tes-tified that he resided on Ninth street. this city, and Mrs. Jenka took her meals at his place. One day, lant ' winter, she came in to dinner and I took a seat by her at the table and be remarked that she was mad. j I afked her what was the Batter, and she said she had had a conversation with Secretary SherrnnD, and that he hod insulted her, and that if be did not look out she would make it hot for him. A few days after she intimated thtit she had, or couid get, or knew of a document docu-ment or letter that was in New Orleans, Or-leans, and on questioning her she Baid she referred to a letter frum (Secretary Sherman to Mr. Weber, the man who was killed. We had many 1 conversations about that matter, and ! finally she came in one day and said the letter was in New Orleans, and that she would have to go home to get .it, but that ehe would be back again in a few daye. William . Chandler testified that he visited Florida soon after the late presidential election and there met Governor Noyes and had many conversations con-versations with him regarding the electoral vote ot that state. Do not recollect telling McLin that Noyes was a particular friend of Hayes and that anything be said Hayes would be responsible tor, and that if the Btate went for Hayes the memoera oi me returning uuaru would be well taken care of; do not recollect any conversation resembling that at all; do not know of such state ment being made by General Lew Question Waa it not understood in Florida, when Governor Noyes came there, that be was n spcoial representative represen-tative of Governor Hayes? Anawer Not in that form, but it was under stood by me that he came there as an intimate friend of Governor Hayes. He did not tell me that be came there at the instance of Governor Hayes, nod i never heard it so Btated as com-i com-i ing from him. j Q. Are you awareof any promises, general or specific, that were made to any members of tne returning board before or after the count, that in case the state went lor Hayes they should be taken care of? A. I havo no recollection of such promise. Q. Did you make such promUe? A Not to my recollection. Q Did you give any assurance to that effect!1 A. Not that I remember. remem-ber. Q. Then you bod no conversation with the members of the board in regard to their getting positions in case Hayes, was inaugurated. A. I am unable to remember that I gave any assurance to any member of the returning board. Q Are yoa ohle to say whether you did or not, positivelyf A. I do not recollect that I did and I believe I did not. That is as well as I can answer the question. The witness testified that be went to Florida at the instance of a member of the republican national committee; did not call upon Governor Hayes or meet him at any time during the trip to Florida and back; bow him in the Onio campaign in 1876 and did not see bim again until after the inauguration. Witness produced a telegram sent to A. Lee, Governor Hayes' secretary, secre-tary, and said this is the telegram re ferred to in the testimony taken before the Knott Florida committee. It is in cipher, but the translation of it is: "Send Stanley Matthews and another high character. Things begin to look fair." Of course I Bent that telegram to Mr. Lee because he occupied the position of secretary to Governor Hayes. I eent it to Captain Lee aa secretary ol Governor Hyes, and lelt him to do what he cheer with my telegram. Of course I should not have sent it to Captain Lse if be had not been Governor Hayes' secretary. 1 most certainly expected that Captain Lee would communicate the telegram to Governor Hayes and be guided by what Governor Hayee told him. I will stand by any reasonable inference infer-ence that can be drawn from it. Matthews, however, did not come. Noyes arrived about a wt-ek after the send ng of the telegram. Witness then read a telegram dated Novem ber lSih, sent by him to Zicb Chandler, which witness translated trans-lated as follows: At a lull conference con-ference with alt our friends now here, we find the work to be done required great and expedioua labor in viewol the shortness of the time, which, if well performed, will, we believe, insure b access. Noyes and Kakbou will be here on Monday, and I wish $3,000 sent to Philadelphia Philadel-phia to the Centennial National hank. Can you also let me have $2,000 more, making $5,000? It looks favorable for about twenty five ma jority in the Btate. You can imagine what the democrats are about. Where is Cook? Signed, "C." It was nn derstood hy the republican managers that Noyes was the intimate Iriend of Hayes. I had no reason to suppose he came in response to my telegram; don't remember any such conversation conversa-tion as McLin details, and I am confident confi-dent no such conve sution took place. I am confident I ne'ver said to anybody any-body in Florida that I waa authorized to make an assurance of tnat kind to them. I might have stated to McLin Governor NoyeB relations to Governor Hayes, but tbat I stated tbem in connection con-nection and witn an assurance of any kind to McLin, I do not believe. Q. You simply put your recollection recollec-tion against his positive statement? A. That's all. I will add that I do not think McLin would have made a statement that be did do! believe? The witness I desire to say that whenever the committee would like to know what waa done with that money I shall be happy to tell them. Did Governor Noyes get any of theae men appointed, do you know? A. I have no doubt but Governor Noyes recommended men for appointment ap-pointment and possibly his recommendation recom-mendation may have induced the appointment of some. I recommended recom-mended some myselt but I would not undertake to say whether my lufiu ence or hia is greatest, but there were quite. a number ot gentlemen ap pointed, I have no doubt, on both his and my own recommendation, by letter let-ter or orally. L. G. Dennis then testified that he was at Tallahassee aoon after the presidential election and there met Governor Noyee. There were two precincts in dispute in Alachua county. I Q What was the contest about concerniog Archer precinct, box No. 1 2, befjrw the returning board? A. It I waa a matter of 219 votes. Q. Did you explain to Governor iNuyea what you regarded as facts I in reference to tha precinct? !a I labored there with Governor I Noyes to establish the votes as shown by ihe county returns. He expressed that desire several times and finally indicated tbat be was going to put me on the Inland and then I advised bim not to do bo, I suggest to him that I should jbe detrimental to his case if he did. I gave him to understand that I did not want to he called to make Any statement under oath. Q Was there anything said by j Governor Hayee? A. He always lepoke of Governor Hayes as hie j intimate friend and usel to assure ub !of bis fidelity to the republican cause ;and of his special desire to take care of the southern republicans, j He never showed me any writing from Governor H-iyes aud did not speak about hiB having been invited by Hayes to go there, but we regarded him aa a persona! trieud and a special representative of Hayes during the rontest there.
