Show THIRD DISTRICT COTBT. Court met yesterday morning at 10 a.m. The cae of the Kuima silver mining company n. the Cincinnati and Illinoia tunnel company was called up; counsel for the plaintiff, Hempstead, Kirk pa trick and Park ; for the defendant, defend-ant, Marshall, Royle, Carter, Smith and Bennett. The jury were sworn at about 11 o'clock, and consisted of the following named gentlemen : Thomas Rogers, Henry Hinman, Jno. B. Thatcher, Danl. M. Burbank, Perry Fitzgerald, Lewis P. Johnson, Isaac A. Caofield, Geo, O- Pitkin, ooch Daley, Enoch Reese, Edwin T. . Mumford, Stephen B. Rose. Mr. j Park, one of the counsel for plain-, plain-, tiff, then presented his side of the case to the jury, and was followed by Mr. Marshall, counsel for defendant, who presented his side. At a quarter to 3 o'ebek Mr. Marshall's statement of the case to the jury was coaoladed, and the regular examination of witnesses followed, commencing with Mr. Silas Williams, a witness on the part of plaintiff. Mr. Williams testified that he had been in charge of the mice since Aug. 1, 1S71, and is still, as superintendent; and his evidence went to show the location of the different tunnels and floors of the mine together with tho direction in which they ran. He was questioned in regard to the flooding of the mine and the barricades erected by the defendant to keep the plaintiff out of the Illinois tunnel. The evidence, so far as it has gone, could only be correctly understood by persons acquainted with the location and works of the mine. Court adjourned till Monday morn-iDg morn-iDg at 10 o'clock. |
