Show Explanation. We had no thought of referring again to the Offlev case. I but the following notice in the Deseret Ktwt of last evening seems to require some explanation : Yesterday the .trial of OfHey, for assault, as-sault, with intent to kijl, on the person of Mr. Sloan, of the Salt Lake Herald, Her-ald, was disposed of. : The defendant was tined $1CU. Judge McKean stated, at the trial, that had it not been that Mr. Sloan had earnestly appealed for leniency to be extended toward the prisoner, no consideration could have saved him from the penitentiary. 1 he Judge dwelt severely upon the unwarrantable unwarranta-ble and brutal conduct of the prisoner. With reference, to. our action in this matter we will briefly say that friends of Offloy interceded in his behalf, that he made an ample apology : himself, and that although we were no more in the case than simple witnesses it was believed a request from us would obtain a mitigation of punishment. On these considerations, and deeming that he had already suffered severely in loss of position and reputation; I Messrs. Sloan and Caiue addressed a communication to Major C. II. Hempstead, Hemp-stead, prosecuting attorney, askinghiui to so represent it to the Court, which Chief Justice McKean was kind enough to receive aud acknowledge, and hence the penalty of fine alone was iruposeiL We may also add that there was no trial, as ho pleaded guilty to an assault with inteut to do bodily injury, and all the Court had to do was to pass sentence. |
