com-pany demurrer withdrawn and consent con-sent given that judgment be taken Case of A L Haymond vs Utah Sugar company was tried a jury being waved This was a suit to recover 108 damages dam-ages alleged to be sustained by the plaintiff because of the defendant corporation cor-poration falling to notify Haymond as to the time for digging and shipping his sugar beets according to contract A motion for nonsuit was made by defendants de-fendants attorneys after the evidence was heard on grounds that it was not shown that the contract had not been complied with by the Sugar company Motion sustained and plaintiff required re-quired to pay costs The case of I N Whitaker vs Joseph Harmer was concluded this afternoon and the jury after a short retirement returned with a verdict of no cause of action on the part of the plaintiff The case of William E Wilson vs Sioux Consolidate Mining company came to trial and a jury was called to the box This is a damage suit Insti tuted by Mr Wilson of Payson who was a miner in the employ of the corporation cor-poration named and was engaged In taking ore out of a mine by means of a horse attached to some cars I is I alleged that this was a very vicious animal which struck him down and 5r run one or two cars over the plaintiff resulting in severe personal injuries to his person Samuel King and Mr Di I ninney appeared for the plaintiff and Judge O AV Powers and Mr Page for the corporation Tlhe case is still on trial Deputy Sheriff Ren Wilkins has just returned from Nine Mile Carbon county coun-ty where he went for the purpose of taking two notorious cattle thieves one I by the name of Maxwell and the other Pete Francis I appears that these I men have stolen 61 head of cattle from cate George AATiittemore and a warrant of arrest has been sworn out against them but the officers down there are not anxious to make service knowing the outlaws to be gun men Mr Wilkins was shown the cabin where the thieves were located but did not advise a raid as there were three girls to children and a woman inside in-side He went in alone however and found Maxwell who was heavily armed and kept his hand upon his revolver Pete was absent at the time but his pal said he would b back in a short time The officer told him he had a warrant for his arrest and also for Pete Maxwell stated that t Whitte mores men were around he would not mresmell go ana mat me omcer coma go anu inform them that i they attempted to take them he would kill off the entire gang He promised however to gb with Wilkins but upon his second visit Maxwell had skipped It was expected that there would b bloodshed at any moment as there is the very bitterest feeling existing between these parties There will probably be an organized posse equipped to capture the thieves Judge Dusenberry went to Salt Lake last evening to meet with Colonel Randlett and a company of Uintah Indians In-dians the purpose being to take some I acknowledgements Marshal Sharp is
