Show I HUMBER IS DSCHARGED Wait Seal the Only Witness Who Testified Against Him J ALIBI CLEARLY PROVEN Very Strange Circumstances in the Case Eight People of Veracity From Anaconda Ana-conda Montana Testify That Humber Was in That City at the Time Scanlon Received the Wounds Which Caused His Death A Most Remarkable Case Special to Tho Herald Herald I POCATELLO Ida May 11The ex amrnation of Charles Humber charged with the murder of Policeman Scanlon in this city on April 5th was continued before Judge Amey today I will be remembered that Mark Seal a miner from Utah after identifying Humber testified to seeing him stab I Scanlon on the morning in question Today Col Ferguson for the defense was on hand with eight witnesses from Anaconda Mont Five of these John S Hickey master mechanic for the Montana Mon-tana Union railway R A Finley a merchant mer-chant O C Voss boarding house foreman fore-man E P Rat < lf a barber and Arthur Ar-thur Cooper his room mates all took oath that Humber was in Anaconda on the day that Seal says he saw him stab the policeman on the depot platform It was a remarkable case in many respects re-spects and Humber is certainly the victim vic-tim of most peculiar circumstances Outside Out-side of Seal there was no one here able I to identify him but all admitted that he bore a striking resemblance to the man wanted for the murder of the policeman An old scar on the back of head tallies almost perfectly with that described by Scanlon before his death also the fresh wounds above the ear made by the offi cers pistol during the melee on the fatal night After weighing the evidence carefully Judge Amey declared there was but one thing left for him to do and that was to discharge the prisoner which was accordingly I ac-cordingly docer Humber made many I friends with those whom he came in contact con-tact with while here and was congratulated congratu-lated by a large number of acquaintances I and others upon his release |
