Show KENNEY JURQRS 12 Ag Second Mistrial of me Delaware Conspiracy Con-spiracy Case Wilmington Del Dec ilLAfter deliberating de-liberating since 6 oclock last Friday evening the jury in the Kenney case was discharged this afternoon without having reached a verdict This is a second sec-ond mistrial of the case Last July Senator Richard R Kenney was placed on trial charged with aiding aid-ing and abetting Teller Biggs of the First National Baqk of Dovem in misappropriating lb cPs i f r appropriating bank funds Bogge has already pleaded guilt and was tIle chIef witness against the senator In both cases After the first disagreement a charge of conspiracy was joined to the oriinal indictment About twelve ballots were taken by the jury On the first they stood eight for aCQuittal three for convIction and one blank The next ten varIed slightly from these figures and on one they stood ten for aCQuittal and two for conviction The last ballot I was the same as the first I t ilr District Attorney Vnndergrift will Fe port the case to department oC justice I jus-tice at Washington and await instruc tions as to his future course Although Senator Kenney will say I nothing concerning the second mistrial his friends profess to be much disappointed I disap-pointed as they had expected an ac I cuittal = |
