Commission yesterday issued the following circular OFFICE OF THE UTAH COMMISSION > SALT LAKE CITY July Ml 1891 f The Utah Commission In view of the approaching ap-proaching election on the 4th of August next deems It proper to reIssue the following circular circu-lar issued JutytW ITo I-To the Officers and ratersof Utah Territory The Utah Commision beIng charged with the duties of registration and elections in the territory terri-tory after due consideration have thought it advisable to make this public appeal to the registration reg-istration officers judges of election and voters at the election to be held on the 4th day of Aug dst next The commission Is desirous of having and so far as I has authority by law is determined to have a fair and impartial election that everything every-thing like fraud shall be put down that every lawfully registered voter in the territory shall have the privilege of depositing his ballot freely n he wIshes and without intimidation and that none who aro not legally registered shall be permitted to vote no matter what may be the circumstance The commission suggests that the judges of election in passing upon challenges at the polls shall do so impartially and fairly rejecting none who are legally qualified admitting none who are not Keeping In mind that the presumptions presump-tions of law arc In faorof tne elector until too contrary is shown Attjntlon Is respectfully called t the following follow-ing section of the election law Any person who bhal disturb or be guilty of any riotous conduct at any election In this territory ter-ritory or who shall disturb or Interfere with the making of the returns or who shall interfere inter-fere vith any voter In the free exercise of the elective franchise shall be deemed guilty of a misdemeanor Compiled Laws of Utah JSSS Vol 1 p 3CJ sec Ji60 It is suggested that prompt arrests be made for any violation of this r trest In the Interest of fairness the commission furthcrsuggests that in all towns and cities no person except the county registrar or his his deputy judges of election the sheriff or deputies the United States marshal or his deputies police onlcers on duty and such challengers not more than two as may be selected by each party and those in line a voters be permitted to remain within one hundred hun-dred feet of the polls atone time and that when one has voted he shall Immediately pass beyond the limit fed for approach to the polls and not return The commission most earnestly invoke all good citizens of all parties to lend their influence influ-ence in aid of a fair and honest election that they frown and stamp upon all frauds or attempted upn tempted frauds tending to unfairness at the polls or In the returns of the election ever keeping keep-ing in mind the great truth that the freedom of the American people depends largely upon the purity of the ballot box upn Tho commission takes great pleasure In bearing bear-Ing witness to the fairness in all elections heretofore here-tofore held under Its authority and management manage-ment and with great confidence looks to the geat same result In the approachinc election The manhood of Governor Wests right to vote on tho ground of nonresi dence Registrar Parsons yesterday overruled over-ruled the objection in the following de cision After a careful consideration of the evidence evi-dence of the different witnesses who testified testi-fied in this case there remains hardly a shadow of t doubt in my mind that it was the intention of Mr West when he left Utah in December last to permanently abandon Salt Lake City a his place of residence The evidence of every witness except one on the stand for tho prosecution prosecu-tion was that Mr West himself in one or more conversations held with these gentlemen gentle-men repeatedly and at different times given them to understand that he was going go-ing to establish himself permanently in business in Washington though it does not expressly appear that he said to any ono of them in so many words I am going to abandon my residence in tb That such was his intention at that time how over there remains no doubt in my mind Yet Mr West has been governor of the territory of Utah and now occupies a prominent position here I have therefore there-fore decided to leave it to him to decide whether he can honorably cast a vote heroin hero-in view of his declaration regarding 1 change of residence from Utah to Washington Wash-ington last fall The challenge egainst W C Dunbar alleging that he was a polygamist was also overruled the courts having previously passed upon that question The objections made against Alfred Solomon Solo-mon and Thomas Matthews were sustained as the parties failed to appear at the time set
