Show I An Exciting Case A strikingly exciting caso occupied occu-pied the attention of Judge Pyper on Wednesday afternoon the offense coming under the ordinance relating to nuisances W S McCornick Esq was the sorrowful defendant and C V Spencer the principal witness for the prosecution and the complainant It appears that Mr McCornick has an ash pit this ash pit is close to the dividing line between Mr Spencer and Mr McCornicks properties and that Mr McCornicks servants are in the habit of putting ashes into this ash pit which is from five to six feet in width and some four feet deep The properties of Mr McCornick and I Mr Spencer are separated by a high close board fence six to eight feet in height and Mr Spencer house is about six feet from the fence and therefore about six feet from the ash pit of Mr McCoinick Mr Spencer did not like this ash pit nor its proximity to his house ant he complained of it the case coming up and being tried yesterday afternoon after-noon Mr Spencer testified that it contained ashes excrement offal etc and emitted an offensive odor The remaining witnesses testified that they could detect no offensive odor that the pit contained ashes about half a wagon load or less that there was a couple of old boots and some little brown paper in the pit and that was all excepting that Mr Park testified to seeing something some-thing like a broken egg in or near the pit After a very exciting contest con-test in which Mr McCornick pleaded his own case as did Mr Spencer who was aided by Judge Miner as prosecutor the affair was submitted and Judge Judge Pyper decided that Mr McCornick should be discharged and the case be dismissed which was done Surgical Opel ation About 2 oclock on Wednesday af tpriioen Dr J M Benedict performed per-formed a very delicate surgical operation on Mr A Quigley of Swan Lake Idaho on the Utah and Northern Railroad The operation was performed at St Marys Hospital Hos-pital and was for the removal of a tumor in the right groin There were present at the operation Dr F D Benedict Dr Williamson Dr Fowler Dr Thompson Dr Young and Dr White An incision some seven or eight inches long had to be made and when the tumor was bared it was discovered to be so complicated a case that some of the physicians suggested that no attempt be made to remove it However How-ever Dr Benedict went to work and in fifty minutes the time taken in the operation a tumor weighing about threefourths of a pound was cut out It was hard and shaped almost like a clenched fist It was also discovered that another tumor was growing beneath the one taken out but the doctors deemed it advisable advis-able not to touch it then In the left groin Mr Quigley has still another tumor which is allowed to remain at present Last night he was doing very well The tumor is of a rare kind and the operation pronounced very successful and skilful Mr Quigley is an oldtimer and has had a very adventurous career At the time the Mormon settlement was established at Lemhi Idaho he carried the express ex-press matter and was so severely wounded by Indians at one time that he was left for dead He carries car-ries a miniature lead mine in his right shoulder now from shots received re-ceived at the time stated He is widely known and has many friends who will be rejoiced to learn that he passes safely through the operation just performed |
