Show REVENUE LAW INFRACTIONS A Few Facts for the Enlightenment Enlighten-ment of Gal 0 J H No one would pretend to assume that a United States official especially a United States revenue official could be partial or partisan in the exercise of his official functions and eaatjikely of all is that any individual indi-vidual would impute anything of that nature to the revenue collector of this erritory Col 0 J Holliater But loweter clear a thing may be to in ellieent minds and as it is to us there are those here unable to com I rebend the reason for certain thing that bear a remarkable semblance to inconsistencies in the course of an officer who treats all alike irrespective irrespec-tive of condition religion vocation or anytbing else Some time ago a great raid was inaugurated upon the Ofop stores for issuing scrip without paying a tax on it the result of which was that Collector Holhster gathered in from these concerns a very handsome hand-some sum for the poverty stricken government of the United States At the eame lima several liquor dealer oigar sellers and brewers were made ta feel the heavy band of the law because of trifling irregularities which are likely to creep into any business in the world and even into that of tbe revenue collector of UUb zealous and careful as he may be Tbe scrip tax fell pretty heavy on eome little stores and the trifling irregulariti 3 if they really were such of the brokers brok-ers liquor men and cigar dealers coat some a handsome little figure before be-fore they got through I About this time also an old eoap I boiler with a spiral pipe attachment was discovered in one of the ward of the city and the deuce raised because of illicit dieting diet-ing progressing and vengeance was wrecked on the old soap kettle or bOiler Still later and on down to the I present time arrests have been made for like oflensee and the oountie have been stirred up in some instances in-stances pretty lively Only a few days ago a man doubtless a good enough or a very good citizen on general principles was arrested at the instance of Collector ELollister on a warrant which charged the offending offend-ing soul with dispensing liquors in Ogden Odion to passers without having hav-ing first obtained a government licenie This poor fallow was hauled down to Salt Lake and taken before the coinmitaioner who baud him over to await tbe action of the grand jury in S5CO bonds Other cases of alike a-like nature could probably be cited And tbo action of the collector in this respsct no one will object to for be is authorized to do it by lawand such authorization assuredly implies a dl1tyns will be seen by reference to the Revised Statutes page 626 section 3241 article 4 where the following will be found Retail dealers in liquors shall pay 25 Every person who sell or offers for eale foreign or domestic distilled spirits or wines in less quantities than five wine gallons at the same time shall be regarded re-garded as a retail dealer in liquors The same section article eighth Bays BaysDealers Dealers in tobacco shall each pay 5 Every person whose business it is to sell or ofler for sale manufactured tobacco snuff or cigars shall be regarded as a dealer in tobacco and the payment of a ipecial tax as a wholesale or retail liquor dealer or the payment of any other special tax shall not relieve any person who sails manufactured tobacco and cigars from the payment of this tax Again section 3243 page 625 reads Tho payment of any fax imposed by the internal revenue law for carrying on any trade or busineis shall not be held to exempt any person from any penalty or punishment provided by the laws of any state fur carrying the same within such I state or in any manner to authorize tho commencement or continuance of such I trade or business contrary to the Jaws ot such sUtoor in places prohibited by municipal muni-cipal law nor shall the payment of any euch tax be held to prohibit any state from placing a duty or taxon the same trade or business for state or other purposes And in other sections will be found the punishment that shall be inflicted upon conviction Bo Mr Hollister but does his duty but here is the resemblance to the inconsistency or partiality For years a certain class of persona in this city have been in the habit of selling liquors without a license of any kind they have been arrested for it by the city police cpn leasing the oQense and pleading guilty have been fined Reference here is made to prostitutes who keep houses of ill fame and who in this land como under the letter and spirit of the revenue law a < 3 much as any others Only a day or two ago five of these women pleaded guilty to the qflensa of selling liquor without a license and were fined 99 each by Judge Pyper which all but one paid Now if Mr Hollister feels it is his duty to drag a man down to Salt Lake for tho commission of this offense and have him bound overbow is it that he finds hie duty so light in regard to these cases It will not do to say he does not know about them because the facts are notoriously public and he cannot help knowing them They certainly are not exempt ex-empt and what on earth can be the collectors reason for such unaccountable unaccount-able leniency is a conundrum that he only can solve In his zeal Mr Hoi hater shows one weak spot and that in favor of a class who certainly de servo no sympathy above other per Bone guilty of similar violations of the revenue law Are you doing your duly Mr Collector or how do you account for it any way |
