possible doubt I think in the mirds thmfiing men in this country that the idea with which this letter closes that a treaty with a great power so far as population pop-ulation is concerned the largest on the earth should not bo abrogated until manufacturing man-ufacturing and other corporations aro conserved in the question of labor simply means until they are tupnl ed to their satisfaction with tbe cheap labor of Chinese Such a sentiment uttered by a presidential candidate would as a matter of course have a moL seious effect but if it be not genuine and is a forgery every thinking man will not only admit but at once entertain with pleasure the thought that the former I should be promptly and severely condemned con-demned Now under such circumstances circum-stances I feel it my duty to sit as an examining magistrate to issuo my warrant war-rant not for the purpose of subserving lie interest of any parlY No approach to me has over been mada on that subject by any person connected with any paty and it is not my intention to conduct this cato ns to lead to any other than perfect and absolute abso-lute truth This application for adjourn n cnt is an ordinary one and will be granted It is in conformity with a universal uni-versal practice Besides on the part of tho prosecuMon extra delays hive been occasioed by tho nonproduction of the letter for which the court was obliged to postpone the hearing in the first place something more than three hours and then by retort to what must appear to every one a very strict construction con-struction of language tho envelope was not forthcoming and five hours more were consumed Theso extra delay caused a loss of nearly half day though tho counsel in this case are not blamaoie for this 1 am not willing to put the case in a false posiiien and I will give both sides every opportunity to present their evidence If the prosecution ar not ready the defense can proceed and give way when tho prosecution are ready I will adjourn the caso until 2 oclock When the court reassembled General Pryor and Mr Brooks counsel for the defense entered accompanied by Bon Abram S Hewitt whose presence gave rise to the report that he was to take the stand as a witness The witness Hogan was recalled by Colonel Bliss for the prosecution but his examination was objected ob-jected to on the grosnd that Bliss WIIS the complainant The objection was overruled and Hogan testified I have submitted the Mercy letter to the micro tcopic test and have fuuad erasures I alfo find on the stamp the figure 2 was printedwhile what I cull the figure 1 is not printed but is a longitudinal stroke and is not set in the same field with the figure 2 Above and a little to the right ot the word Morey there h evidence ot two erasures one word that I think is Esq and in the other there is no word The erasure to the left of Esq is continued and is nearly in line with the line The stamp on the reverse of the envelope snows evidence of two erasures with a ring Under tho word Moray there is evidence of erasure Just under tho letter Y the letters or are written over the erasure The word Lynn is written below a portion of the erasure and there is a little erasure above the Mass Crossexamined by Mr BrokeI examined ex-amined the envelope at the postoffice in the presence of Mr Bliss Mr Stoughton Mr Gaylord Mr Fink and Mr Knox I dont Know who brought it there Judge DavisI entrusted it to Mr Bell BellMr Mr BrooksI understood the letter was not to go out of your honors control and I call vour honors attention to tho fact that the letter is not in tho same condition con-dition as when delivered it JuJgo Davis I cut oil part of the edge The tears in it were all there Charles Hoffman was then called and testified as follows The photograph of the envelope was made under my supervision super-vision I received it from Mr Hart and it is now in the same condition as when 1 received it I noticed no erasures I did not look for them John Phin testified I reside in New Jersey have made the microscope a study for twentyfive years have been called as a witness as an expert before saw tho Morey envelope some two hours ago and have examined it under tho microscope The surface ofthopaperis disturbed in many points which can be discovered by holding itto the light Several points along and above the name the fibres are disturbed there is an erasure above the worst Morey in had evidently been the word Esq Disturbances of the fibre are on the outside of tbo envelope Thero is a disturbance on the stamp on tbo reverse but no more than ordinary fric lion would cause I do not think it an erasure Tho figure 2 seems to have escaped Before the 2 there may have been an extra degree of rubbing The microscope shows that the figure 1 alongside the figure 2 was not stamped On the face of tho envelope I saw tho word Esq but could not tell what other erasures there were there are somo small spots of ink under tbe word Representatives that them the-m rk was stamped It has beenstamped twice cehmei J sines tiaylor general superintendent of the City Delivery Postofike testified When a letter Addressed to someone some-one in this city arrives it goes into a I locked apartment It is taken out and stamped with the receipting sttrap which indicates the hogr it was received I Tho stamp shows the month and dy Stamps have on them Bee New York and the date That stamp is put on all letters for city delivery and on them only If the letter arrived here from Washington passing east it would not have been treated in my division There ire nineteen stations in the city and a 1 otters intended for a district are sent to that district and stamped with the station stnmp On the stamp on the reverse ot the Morey envelope I recognize the stamp bearing the words Kec New York 739 The figure 2 is in the place where the date if i The figure on the sido of it I do not think was stamped there We uso the stamp every day but change the date the dates being nude in a single piece The stamp on the Morey letter Indicates its receipt in the New York ostoffico and ifit was sent from Wash ngton to Lynn that stamp would not he there The heavy ring on the envelope elope looks like one of tbe stamps used in the city stations The envelops pre ents indications of disturbances An abrasion on the station stamp covers the place where the date would be I have teen many of the stamps on letters received re-ceived from Washington The figure 1 adjoining the figure 2 on the stamp on the reverse of the envelope is tot made by a dip No crocsexamination Hency J Pearson was called for the prosecution and testified that ho was as sistant postmaster ana nad been sucu for seven years Letters from Washington to Boston are put in pouches in Washington Wash-ington and sent right through The pouches are not opened in this city In the case mail is delayed the pouches would be taken to the New York post office and the package would be super-intendent of the city delivery department depart-ment of the postoffice havo been so for seven years letters received re-ceived for city delivery only are stamped The time stamp is changed every thirty minutes and a proof taken of it and certified to before it can be used The figure 2 on the Morey letter is the last letter of tho double date fsexamined by General Pryor Before my engagement in
