corrections officer will provide “a little bit of justice” said Gary House brother of the slain lawman Third District Judge Michael R Murphy sentenced clan leader Addam Swapp 27 and law John Timothy Singer 22 to one to 15 years in Utah State Prison for manslaughter and Swapp’s brother Jonathan 21 to a year in jail for negligent homicide The sentences Thursday were pronounced two days before the first anniversary of the Jan 28 1988 shoot-oat the clan’s Marion compound that ended a standoff with state and federal officers Corrections Lt Fred House was killed and Addam Swapp was wounded in the exchange The impasse had begun 13 days earlier when Addam Swapp bombed a Mormon chapel near the remorse over House’s death none had acknowledged responsibility for the consequences of their actions All three have denied having any intention of harming anyone “These defendants acted as anarchists and this court has been presented with no credible information that if given the opportunity they would not again engage in anarchism and armed conflict” Murphy said House’s widow Ann House said “I'm satisfied with the sentences and I don’t want Fred ever forgotten We need policemen to stand between us and irresponsible and dangerous people” House’s sister Dawn House said the judge was eloquent in his contrast of the nonviolent civil disobedience of “Thoreau Gandhi and Martin Luther King (who) were willing to accept the legal consequences of their conduct” the judge said while “These defendants bore arms in support of their views and to avoid the consequences of Addam brother-in-- ut farm Singer and the Swapps originally were charged with second-degre- e murder but were convicted of the lesser charges on Dec 22 by an jury that deliberated 7Vi days Defense attorneys sought to have Singer’s and Addam Swapp’s terms concurrent with the federal terms they face for the bombing and standoff The defense attorneys contended Utah law prohibits aggregate minimum sentences of more than 12 years including the federal terms However Murphy ruled the law did not limit his discretion in imposing indeterminate consecutive sentences He said ordering concurrent terms “would require this court to disregard the death of officer House” and that the trio’s armed resistance constituted “irrefutable evidence of the grave risk of injury and death” they had created during the siege Moreover he
