ONE MAYORS PERSPECTIVE TO THE MESSENGER’S ACCOUNT ON THE TURMOIL IN STERLING I wish to go on record with some of my opinions and concerns about the incidents reported. First I have no first hand knowledge of or information on the issue or issues in Sterling. My opinion is based solely upon my experience as a mayor. The Mayor is the Chief Executive Officer of the community. The mayor is the chief law enforcement officer of the community. Employees of the community serve at the pleasure of the mayor and city council. The mayor has the ultimate responsibility and accountability for community properties. If, as stated in the article, a department head exceeded their department budget by 270 percent (two hundred seventy percent) without justification to and permission from the governing body, city council and mayor, they should be audited, investigated and disciplined or removed. If an employee of a community refused access to any city property to the mayor for any reason that employee should be disciplined or terminated. The mayor is the elected custodian of all city property. If an employee refused to justify expenditures, refused a summons from the council to appear, or failed to complete assigned tasks in a timely manner that employee should be disciplined or terminated. If as alleged a former employee of a community entered city property and removed items without express permission by the governing body that former employee should be charged with trespass, unlawful entry, and theft of property. Once terminated a former employee’s responsibility for or right to city property is also terminated, even should that employee retain a key or other access capabilities it is logical to assume that the right to use them is also terminated. Any use of them to access city property is inappropriate and probably illegal. Anything removed by such means without the express permission of the governing body should be considered stolen and evidence of a potential crime. If an employee uses city property for other than official city use that employee should be investigated for theft of services or other infractions. If it was personal items that were removed then the proper city officials should have been involved. Not the sheriff. If non-personal items were removed without the express permission of the city council and mayor then those involved need to be investigated and perhaps prosecuted. If an employee is uncooperative, ineffective or unaccountable the city council and mayor are ultimately responsible The mayor and city council are within their rights to expect employees to perform their duties and be accountable in their performance on their job.
