the Big Muddy field of Wyoming The Producers' Oil company brought in one in its section 5 west of the Elkliorn and the Merritt well in the center of its section 8 began making gas and oil at a rate which forced the removal of the boilers to a point of safety indicating the near completing of the drilling The Producers tapped the oil at a depth of 1100 feet in what is either the Shannon or a stray intruding sand and its Initial flow was at the rate of 1000 barrels per day That the Merritt will equal other wells in the productive area of Big Muddy is to be expected While both wells are in claim on oil locations referring particularly to seepages: Ordinarily oil is found by drilling or boring into the interior of the earth and it either flows from a well drilled or is pumped to the surface The court in thecase cited made an additional statement to the effect that "until some body or vein has been discovered from which oil can he brought to the surface it cannot be considered of sufficient Importance to warrant a location' under the mineral laws" This was salf with reference to the particular case in hand and in the absence of any seepage and as a conclusion by which actual knowledge of the presence of oil was made known But the admission Is and It reflects the common experience of oil operators that when a well is drilled the oil either "flows or is pumped to the
