Show Thursday, September Constitutional Amendments But Danger Still Exists Outlined For Public Editors Note: This Is the first In a series of four articles on the four amendments to the Utah Constitution which Utah voters will be asked to vote upon November 7th. Proposition No. 1 has been placed on the ballot as a result of recommendations by Utahs Constitutional Revision Commission. It reads as follows: Proposition No.l: LegislaShall tive Article Revision Article VI of the State Constitution be revised tomakechanges in the procedure and manner of operation of the State Legislature and the legislative branch of state government, Including rules and prothe cedure? (The present law and the proposed revision will be on cards in the polling place and booth.) ng This amendment proposes four significant types ofclian-g- es in the legislative article of the Utah Constitution. They are: (1) adding three new sections designed to increase legislamodernitive effectiveness, zing certain legislative procedures, (3) clarifying ambiguous provisions, and (4) removing d. unnecessary detail and dead-woo- Three new sections are pro- posed to increase legislative effectiveness: (1) A legislative auditor is empowered to perform audits of any subdivision of state govern- ment. This section for the first time provides the means for the Legislature to follow pubUc funds beyond their appropriation and, in fact, become the "watchdog of the public purse that the constitution requires. Proponents of this measure stress that it is particularly important that the Legislature perform its role in auditing state expenditures, in view of the recent Utah Supreme Court decision which names the State Auditor as the only officer authorized to disburse public The time by which a (2) candidate for the Legislature must meet the requirements is clarified. Present provisions are unclear as to the eligibility date. (3) The date on which laws become effective is made definite. The effective date presently is linked with the publication date, making a variation in the dates on which laws become effective. Since it is also unclear what constitutes publication, the compounded. problem is Removing Deadwood (1) The specified form for enacting clauses of bill s is deleted. It is the prevailing opinion that such detail is not necessary in the Constitution and should be specified by statutory law. (2) The long list of special laws prohibited by Section 26 is deleted in favor of the general statement prohibiting all special laws where a general law is applicable. All of the specific laws listed are prohibited by express or implied provisions elsewhere in the Constitution. (3) Sections 27 and 30 are deleted as having little meaning or application today. The sections prohibit the Legislature from releasing debts to the state or from granting extra compensation to an officer or contractor. The executive branch has the authority to grant extra compensation and release or negotiate debts, and the authority is regularly used.
