Apparently Ap-parently Without Reason Committed Com-mitted the Deed I the Presence of His Wife State Nc > From The Heralds Correspondents Logan March 2SA fearful tragedy occurred her at 1130 this morning when Herman Vogel the proprietor of the Logan City brewery attempted suicide sui-cide by shooting himself in the head with a double barreled shotgun The whole lower jaw of the wouldbe sul I < Jde was shot away and the rest Of his I face up to a point half way between the mouth and eyes is terribly torn presenting a most shocking spectacle The gun had evidently been placed un ilep his throat and in endeavoring to rtach the trigger of the weapon with his hand his head was thrown back so that the charge of shot but carried away the lower part of his face whereas where-as he intended to blow his whole head off In this connection it is rather strange however that he fired but one barrel of the gun when he found he had not killed himself as he was quite conscious when fdund and there was another loud in the gun The deedwas committed in the bottling bot-tling house which is across the street from the brewery and but a few steps from his residence Vogel sat on the edge of the bottling vat and fired the gun As soon as the report was heard his wife and some of the men employed em-ployed by Vogel rushed to the building build-ing and found him sitting on the floor while blood and pieces of flesh were scattered all over the room The marshal mar-shal and the Drs Ormsby were immediately imme-diately summoned and when they arrived ar-rived Vogel was led into the house where being furnished with a paper and penci he wrote and signed the following fol-lowing statement I have done this of my own freewill free-will and F C Kidgell is the cause of it H P VOGEL KIDGELLS STATEMENT Your correspondent interviewed Mr Kidgeil who Is a stepson of Vogel and found that he was quite astonished at the statement made b Vogel Mr Kid gell who has worked for Vogel for years had a little dispute with him on Saturday evening over a matter of wages and failing to agree Kidgell intimated in-timated that he would sue for the I amount Since then however nothing has passed between them and no one suspected that Vogel had taken the matter so seriously Kidggll came downtown down-town this morning and after consulting an attorney concluded to let the matter mat-ter drop Jf he could not settle It peace rg I ably but he had not spoken of the matter mat-ter to Vogel or any one else In response re-sponse to the question as to whether any threats had been made on Saturday Satur-day evening Mr Kidgell said that the only threat made was that of his Intention In-tention to enter suit Vog was a hard drinker and on Saturday evening was very much the I worse for liquor and as he has been I drinking considerably since that time I is thought a desire for revenge when crazed from the effects of the liquor caused him to cpmmit tie act lr Vogel who is nearly crazed with grief it is claimed said that she witnessed the shooting Vogel went down town it Is thought to procure the ammunition ammuni-tion to kill himself with and returning aecurtu toe bun ann startec lor the bottling house According to Mrs Vo I gels statement she followed him and demanded the gun but Vogel placed the muzzle under his chin and remarking remark-ing that he would like to see her get it fired the shot that blew his javoff Dr Ormsby after examining the wound pronounced It a hopeless case Vogel unable to swallow being swlow anything whatever and the prospects are that he will starve to death unless the physicians phy-sicians devise some way of feeding him through a tube Vogel was on Main street 15 minutes before the tragedy and evidently was in the best of spirits chatting quite freely and good natured ly with his acquaintances yet he went straight home and committed the act which has shocked the community Vogel is a German and has lived in Logan for a long time He is about 55 years of age and without family other than his stepchildren The habit he had of avoiding liquor at times and drinking to excess at others was undoubtedly the main cause for the commission of the shocking crime Threequarters of an hour after the shooting Vogel was still in command of all his faculties and got upon the operating table himself him-self without any aid whatever to have the wound dressed He presented the most revolting sight imaginable His I wife is utterly prostrated and unable to see anyone At this writing the doc tois are still at work dressing the wound Vogel is a member of A O U w lodge No 14 and in case of death his wife will receive the 2000 accruing to the families of members of that organization organ-ization of which he had always been an active member PARK CT BRIEFS Challenged Vernali March 4The attention of the district court was almost wholly occupied today with the caFe of Joseph Leathern who Is charged with assault with attempt to rob committed on the person of John McKeachine last Janu arv between Ashley and Deep Creek The circumstances of the alleged holdup hold-up appeared In the columns of The Herald at the time of the preliminary hearing Todays counter claim cam I for damages in the sum of 299 and costs l During an Interval while the sheriff was rounding up a witness Robert and Charles Atwood were brought into court to plead to the charge of a grand larceny They pleaded not guilty The case of Robert was set for tomorrow at 2 oclock the case of Charles to be taken up at the conclusion of theformer FOR MALICIOUS PROSECUTION The case of Yarnell vs Kabell was set for next Monday In this case the plaintiff prays for damages for alleged I malicious prosecution At the last term of court Babel swore out a warrant charging Yarnell with stealing sheep Yarnell was tried and acqu ted by the I jur and now asks damages in the sum of 5000 The court has as yet made no regular I setting of cases but they are being I taken up as exigencies of the case demand de-mand In order to expedite matters S R Thurman has been secured to assist the prosecution in the balance of the criminal cases before the court LEATHEM CONVICTED Vernal March 25The following business was transacted in the district court here today This morning the closing argument in the Leathem case was delivered by County Attorney Luethi and the case submitted to the jury The jury remained out several hours ahd finally returned a verdict of guilty of assault Sentence will be pronounced at 10 oclock tomorrow The demurrer to the information filed nl the Rowley burglar case which was argued yesterday was sustained sus-tained by his honor today and amended information was ordered filed A demurrer was enterd in the McKee Mc-Kee assault case on the ground that the preliminary hearing before the committing magistrate was irregular in that the acting prosecuting attorney I attor-ney C P Goble was not duly sworn as prescribed by law and further j I that County Attorney Luethi assisted in the examination contrary to law he being the complaining witness in the case The demurrer was argued and his honor took the matter under advisement JURY PANEL CHALLENGED The case of Robert Atwood charged with horse stealing wascalled and a jury impaneled Counsel for the defense de-fense challenged the jury on the ground that the venire was not drawn within the time prescribed by law in that I was drawn on March 17 and court convened on the 23rd of the same month contrary to the statute sta-tute which provides that the venire shall be drawn at least 15 days of B Malan who hails from Ogden and is here with a companion canvassing for a picture enlarging concern con-cern was arrested on Saturday evening even-ing on complaint of William Goodsell of the Fifth ward who alleged that Malan took a photograph from the house without the permission of anyone any-one there and further that he made improper advances to Mrs Goodsell the complainants wife Malan was accused of Indulging In a rather racy I conversation with the woman and of attempting to put his arm around her waist nearly all of which he Indignantly Indignant-ly denied when arrested He put up his watch as a guarantee for his appearance I ap-pearance this morning when Marshal Farr who had thoroughly investigated I the case dismissed the charge having been unable to find sufficient evidence to convict The young man is said to belong to a very respectable family in I Ogden and he Is very indignant over the charges made against him by the woman 1r Annie Crockett the wife of Mr Alvin Crockett PAYSON PIONEER DEAD Walter H Huish a Prominent and Influential Citizen Pa son March 28 Walter H Huish died yesterday morning about 1 oclock after a brief illness aged70 years He leaves a wife and family of ten chil I dren half of whom are grown and married He was a prominent man and influential citizen HIseldest son John E Huish is bishop of the ward I of Payson Walter H Huish was born I at Riley Gloucester England Oct 31 187 I He was married to Ann Smith I June 12 1848 near Birmingham England Eng-land and immigrated to St Louis in 1S49 He came to Utah in ISaa and after a brief stay at Salt Lake City moved to Payson the same year and has ever since lived here His wife died at Payson April 22 18SO leaving six children He married Christine Larson at Salt Lake Aug 23 1893 by whom three oclock occurred the death of Mrs S A Brinton after an Illness I of about 24 hours Death was caused by diabetes and the rapid and fatal termination of the disease occasioned great surprise and came as
