Show t BENCH AP BAR The Petit Jury Selected for the September Term 1 THE SCHOOL TAX CASES AGAIN I J I The MoneyMust be raid Into CourtThe I Collectorship Case Business In I County and Probate r The work of selecting a petit jury for 1 the September term has commenced before Judge Anderson in tho Third District court i yesterday morning The venire was for thirty jurors but only the following responded re-sponded John Rideout William G Park Ezra I Foss Melvin Miller George Vf Herron Dan Wolstennolm George Braston William i Will-iam C Walker Michael Earl L Ensign Roscoe E Savnge L J Ruth William H Stevenson Con Driscoll John F Kincaid H S Shurtliff William Stewart Arthur t Cushing J C O Irving Timothy Driscoll i J A Lenzi Chris Larson Prosecutor Stephens examined the jurors I 1 as to their statutory qualifications the following I fol-lowing questions being put to each Are you a citizen of the United States 1 I How long have you resided in this district dis-trict i trictAre Are you a taxpayer J Can you read and write Have you over been convicted of a felony 1 Have you any bodily infirmity that wonld incapacitate you from serving as a juror Art you subject to the military authorities authori-ties of the United States Aro you willing to take the Edmunds Tucker oath Ezra FOSS was excused because he was hard of hearing A J Gushing was allowed to go because j of business engagements M Earl wanted to be excused because he had asthma but the court decided to let him go J O O Irving presented a physicians certificate setting forth that his health would interfere with his service as a juror but Judge Anderson thought he had better stay and try it anyhow Chris Dawson had the atarrh and one of his ribs was stove in but he was not excused < < The remaining twelve were sworn in POVtERS KECOVEKS LEGAL FEES The first called for trial was that of O V v Powers vs Thomas G Bywater It seems that some time ago the defendant was working on tho chain gang at the city gravel banks when he was badly injured inn in-n cave Afterwards so the plaintiff alleged al-leged By water came to him and engaged him to commence suit for damages on a contingent con-tingent fee Judge Powers proceeded to look up the law examine the witnesses and draw up the complaint but the defend nnt never came back to his office and afterwards after-wards Williams C Van Cott took up the damage suit and comprcmised with the city for 1000 Judge Powers then brought suit to recover 5100 for his services ser-vices The trial occupied but a short time and the jury returned a verdict in favor of the plaintiff for the amount claimed J J Buyans vsM Shaughnessy judg m nt for plaintiff by default John Murtha administrator vs Edward Theriot et al dismissed P Werstheimer vs Kate Murtha same D J Clark vs Bolvar Roberts et al leave granted to file supplemental complaint com-plaint |
