IS BE IT ORDAINED BY THE MURRAY CITY MUNICIPAL COUNCIL OF MURRAY CITY UTAH, AS FOLLOWS: (c) Low and moderate income. Persons who are eligible for assistance under the guidelines as established by this ordinance are low or moderate income persons The guidelines may be adjusted periodically by the City Council to reflect changes in economy SECTION I The Murray City Municipal Council finds and declares that, pursuant to order of the Council duly made at a regular meeting held September 17, 1985, and In pursuance of the provisions of Section et seq., Utah Code Annotated 1953, as amended, there was duly published for a In excess of twenty (20) days, beginning period September 19, 1985, and ending October 10 1985 in the Murray Eagle Newspaper in Murray City a Notice of Intention of said Council to create a Murray City (4800 South) Special Improvement District No. 15, for the purpose of malting improvements as indicated therein and to levy tax for the improvements to defray the expense for construction of the improvements Such notice also specified that written protests were to be submitted on or before October 15, 1985, The written protests so filed amounted to less than (23) of the frontage represented and was Insufficient to deprive the Council of Jurisdiction to make said improvements and levy said tax as provided by Statute herein stated, et seq., Utah Code Annotated Section 1953, as amended. (d) Grantee. A person residing within a properly adopted improvement district who receives assistance under this program. (e) Grantor. The city of Murray shall be the grantor for purposes of this Ordinance. Chapter Eligibility. A person to be for assistance under this program must: eligible a) Be a resident of Murray City. b) Own or be in the process of purchas- ing the unit c) Reside within an authorized improvement district. d )Meet Income Guidelines as set forth herein (1) Income guidelines. Installation of curb and gutter upon all parcels of land and lots along the south side of 4800 South from Atwood Blvd to Lincoln Street; and on the north side of 4800 South from Atwood Blvd. to Millrace Lane; sidewalk installed on the south side of 4800 South and no sidewalk on the north side of 4800 South; all new curb and gutter is installed with the property owners and the city each paying fifty percent of the cost; and all existing curb and gutter replaced by the city at no cost to the property owner in Murray City, Salt Lake County. (3) All applicants must allow and authorize the city to verify the monthly income of the household as well as any savings accounts prior to city certification of eligibility Chapter 3. Assistance guidelines, (a) A person falling within the above listed Income and savings classification and meeting all other eligiblity requirements as set forth herein shall be entitled to 100 assistance payment by the city to meet improvement assessment That the total cost of the above described improvements is in the sum of $14,265.24 That the abutting property cost of all property as hereinbefore described in Special Improvement District No. 15, per front or lineal foot of curb and gutter is in the sum of $2.58. That the Treasurer of Murray City is hereby authorized and directed to make assessments in accordance with this Ordinance for the purpose of defraying this cost. SECTION III That the assessments lists as made and prepared by the City, and as corrected, approved and completed by tne Board of Equalization and Review for Special Improvement District No 15 is hereby confirmed and the assessment made and returned m said completed lists and the report of the Board of Equalization and Review to the Municipal Council at Murray City, Utah, is hereby ratified, approved and confirmed, and this District is created and the assessment levied under authority granted and in the manner set forth in Section et seq., Utah Code Annotated, 1953, as amended. SECTION IV Said tax shall be payable in ten (10) equal yearly or annual installments as provided by law and ordinance, with interest on the whole sum unpaid at a rate of ten per cent ( 10 ) per annum, payable at the time each installment is due, and the first installment shall be due and payable at the Office of the City Treasurer of Murray City, Utah, on the 15th day following the effective date of this ordinance. In the event any installment or the interest aforesaid is not paid on the day the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable and shall draw interest at the rate of ten percent (10) per annum until the sale of the property assessed, as provided by law, including all costs of collection and reasonable attorney's fees. (c) The balance, if any, due from the grantee after city participation shall be collected in the same manner and over the same period of time as residents of the improvement district. All grantees under this program will have any assistance received, depreciated by 20 per year from the date of the final Board of Equalization and Review If the grantee sells the unit at any time prior to 100 depreciation of assistance received, the grantee wifi be required to repay the outstanding amount of assistance to the grantor.
