Coming nyy to the second subdivi- sion of land included in the petition the Lagoon is, as has been stated, am as its implies, an amusement park of lakes and landscaped grounds, possessing all the features common to such a park, and in addition the most artistically laid out, the most carefully kept, and the most delightful gardens in the state, so that it has earned the title so frequently applied to it by the witnesses on both sides of the mo.st beautiful spot in Utah. To this resort, as mighl be come thousands during the expected, season, sometimes daily, from the cities and' tow-nto the northward and the southward, many coming from Farmington itself, seeking surcease from the dread heat of summer in this idyllic retreat, wherein rapture it the glories oflna-turthe "trials and difficulties of modern life are for the once forgotten. It seems to the court that' for many reasons such a resort as this, located as it is, immediately west of the central portion of the town, in order that the conduct of the thousands visiting ic from abroad, as well as those who live in Farmington, may be in order that the characterregulated, of the amusements indulged in may, so far as they affect the residents of the be restricted, should be within the city, corporate, limits of the city. It is possible that if this land were not put toHhe uses it is, a different view might for the land is somewhat lowdying, was originally better suited for pasture and meadow than for farming, is hot as suitable for suburban homes as most of the remaining land within the citylimits, g though it is not as to the south of it, which is within the city, limits, and is ,not sought to be segregated. But as long as it is devoted to the purposes to. which it is now devoted, the court is very clear in concluding, as was intimated in its conclusion at the close of the trial, and which conclusion has not been changed by further reflection, that it should not be segregated. Coming now to the land lying north of the Lagoon, we reach that portion about which there is more doubt than any of the remainder. The eastern portion of it is not essentially different in character from the remaining land in Farmington, and can be devoted to the same purposes. The western portion, on the contrary, is g and some of it indeed marshy in character, and without the expenditure of more money than would be justified by the needs of the city for many years to come, not suitable for suburban homes. This land at best so far as the race track is concerned, also extends much farther to the west Re.-o- rt CITY OF FAMINGTON w The following decision in the case of Geo. From this central body two wings or strips are extended ten chains in width on either side of the state- highway which passes through them as well as the central portion of the city, thus bisecting it and forming its principal street. One of these wings extends to the south, the eastern boundary of the central portion of the city constituting the eastern boundary of the south wing.
