BLODGETT shame I cant practice my occupation Layton City Council voted to continue denying beauty shop establishments as home occupations. 3-- 1 THE DECISION came after more than an hour of emotional public hearing with Councilman Randy Harris voicing the dissenting vote. There were a lot of pros and cons to the discussion about having beauty shops located in homes located in residential areas of the city especially since Layton is one of only three Davis County communities not to allow salons as home occupations. ALSO DISCUSSED at length were problems of other cities, especially neighboring Clearfield which recently was faced with, but won, a law suit charging discrimination. Mrs. Linda May was the petitioner in the Layton hearing. She said she had asked the city council to amend its home occupation to allow beauty salons in residential areas last February. "I HAVE talked to all my neighbors and they do not oppose having a beauty salon in my home, Mrs. May told the council. Clearfield, Sunset and Layton are the only communities in the county to disallow beauty salons as home occupations and I think by doing so you (Layton city) is discriminating against this profession. She denied that home beauty shops are any less professional in their operations and standards than regular beauty shops located in business districts. I KNOW many women that would prefer going into a home to have their hair cut and styled than venturing to a downtown establishment, she said. It's not degrading to business shops because most of the operators of home salons would be prior employers of business salons who have decided to go into business in their home. We are all licensed operators and I think its a SHE CITED several women who have formerly worked in downtown shops and who now have home occupation shops in cities other than Clearfield, Sunset and Layton. But Tom Winegar, chairman of the Planning Commission, said the planning commission members had different feelings about home occupation beauty salons. Layton HE SAID that by a vote, the commission voted against amending the ordinance because of difficulty in enforcing beauty salon operations in the residential areas, because of traffic problems such a business would create, and because of the impact home beauty salons would have against downtown establishments. CHARGED with the offense is Carlos Martinez, 24, of 746 East 400 South, Clearfield. The charge stems from an incident last Dec. 29. A preliminary hearing date has not been set.
