PREAMBLE We, the Associated Students of Weber State College, in keeping with the rules and regulations of the Administration and Board of Trustees of Weber State College, in O'rler to insure effective selfgovern-ment, to promote harmony and cooperation between students and faculty, to provide facilities and programs capable of fulfilling the needs and interests of the students, to creat e an at mosphere conduct i ve to scholastic achievement, and to promote academic and social activities, do establish this Constitution. ARTICLE 1 Name and Responsibilities Section 1 . This organization shall be known as the Associated Students of Weber State College (ASWSC). Section 2. The Associated Students shall be responsible for the efficient and effective functioning of student life within the jurisdiction of the authority vested in ASWSC. ARTICLE 2 Membership Section 1. All full-time students registered in any quarter who pay the student activity fee for that quarter shall be members of the Associated Students during that quarter. Section 2. Members of the Associated Students are entitled to all rights and privileges granted in this Constitution. The responsibility of memberships involves the support of said Constitution and participation in the affairs and act i vit ies of t he Associat ion . ARTICLE 3 Officers and Structure Section 1. The officers of the Associated Students shall have elected annually by membership. These officers shall be: President, Executive Vice President, President, Legislative Vice President, Activities Vice President and Financial Vice President. Section 2. The Associated Students shall function through: the President who is chief officer of student government, the Executive Branch, the Legislative Branch and the Judicial Branch. Section 3. All officers and branches shall have the primary duty of ascertaining student opinion and representing it in their respective functions. ARTICLE 4 Duties and Responsibilities of the Officers Section 1. The President shall: (a) be responsible to the Administration and Board of Trustees of Weber State College for all functions of the Associated Students, (b) head all branches of Student Government, requesting and receiving reports as necessary, (c) serve as chairman of Executive Cabinet, ( d ) see that all functions of Student Government are handled properly, (e) assist in the promotion and coordination of the joint student-faculty standing committees, (f) serve as chairman of the Weber State Union Policy Board, and (g) have the power of veto over ASWSC Senate actions. Section 2. The Executive Vice President shall: (a) assist the President and assume the President's duties in his absence, (b) be responsible for the public relations of the ASWSC (c) coordinate student publications, (d) coordinate ASWSC involvement in College cultural programs, and (e) fulfill other duties as assigned by the ASWSC President. Section 3. The Legislative Vice President shall: (a) represent the President as member of the ASWSC Senate, (b) be President of ASWSC Senate, and (c) fulfill other duties assigned by the ASWSC President. Section 4. The Activities Vice President shall: (a) be responsible to the ASWSC President for all social activities of the ASWSC, (b) coordinate ASWSC involvement in the Weber State College Homecoming activities, (c) serve as chairman of the Weber State Union Activities Board, and (d) fulfill other duties assigned by the ASWSC President. Section 5. The Financial Vice President shall: (a) be responsible to the ASWSC President for all financial involvement of the ASWSC, (b) be chairman of any financial boards as set up by the ASWSC Constitution or the ASWSC Senate, and (c) fulfill other duties as assigned by the ASWSC President. ARTICLE 5 Executive Branch Section 1. The Executive Branch shall administer the affairs of the Associated Students. It shall enforce and put into operation all statutes duly passed by the Legislative Branch. The Executive Branch shall consist of the following: (a) Executive Cabinet and (b) Executive Councils, boards and bureaus appointed by and responsible to the Executive Cabinet . Section 2. The Executive Cabinet shall consist of the following: (a) the President, Executive Vice President, Legislative Vice President, Activities Vice President, and Financial Vice President, (b) the Dean of Students, (c) the coordinator of Student Government, (d) the Legal Advisor appointed by the President of ASWSC, and (e) all members of the Cabinet shall serve with voice and vote, except the Legal Advisor who serves with voice only. Section 3. The duties and responsibilities of the Executive Cabinet are: (a) to meet weekly during the regular college year at a specified time and place, (b) to recommend legislation to the Senate, (c) to employ a Student-body Secretary (the secretary may be removed by two-thirds vote of the Cabinet), (d) to establish councils, boards, and bureaus and to take action on any matter within the jurisdiction of the Associated Students that may not be covered by statute, and (e) to oversee budget hearings and to recommend a budget to the Senate. ARTICLE 6 Legislative Branch Section 1. The Legislative Branch of the Government shall consist of the Senate. The membership shall be as follows: (a) the Legislative Vice president, who shall be the president and Speaker of the Senate, (b) one Senator from each academic school, (c) the AMS and AWS presidents, (d) the four class presidents, (e) one Senators from the Residence Hall Council, (f) the president of Intra-Fratemal Council, (g) two Senators at Large elected by the entire studentbody (h) the advisor who will be the Coordinator of Student Government who shall serve without vote, (i) one faculty member appointed by the Academic Council, ex -officio capacity with voice but without vote, (j) Dean of Students ex-officio capacity with voice but without vote. Section 2. The organization and function of the Senate shall be as follows: (a) to create and fill such offices and to make such rules as it deems necessary for the Senate's operation, (b) to meet at least once a month. Special meetings may be called by the Speaker and the Senate or a petition signed by a majority of the membership of the Senate, (c) majority of the Senate shall constitute a quorum, (d) senate meetings shall be open to all members of the Associated Students, (e) to require reports from Executive Cabinet and any or all other agencies of the Associated Students; to investigate, adopt resolutions, and perform all normal legislative functions on matters within the jurisdiction of the Associated Students, (f) the Speaker of the Senate shall serve without voice and shall vote only in case of a tie, (g) the Senate shall be governed by modified Robert's Rules of Order, (h) to appropriate the budget among the campus organizations subsidized by the Associated Students with recommendations from the Executive Cabinet, (i) the Senate shall have the power to override the President's veto with two-thirds majority vote. ARTICLE 7 Judicial Branch Section 1 . The responsibility of the Judicial Branch shall be to interpret the Constitution, determine constitutionality of legislation, and perform any other judicial functions of the Associated Students. Section 2. The Judicial Branch shall consist of the following: (a) the Supreme Court which shall consist of four Supreme Court Justices appointed by the Executive Cabinet and approved by the Senate and a Chief Justice appointed by the President of the Associated Students and approved by the Senate, (b) such lower courts as the Supreme Court deems necessary subject to the approval of the Senate, (c) an advisor appointed by the President of the College who shall serve without vote. This person shall not be an advisor to the Legislative or Executive Branch. Section 3. Questions or disagreements as to constitutionality, legality, jurisdiction, or non-performance of constitutional or statutory mandate, must be referred to the Court by the Legal Advisor upon a ruling of the Court. Reasons for decision must be rendered in writing and given to the parties concerned within two weeks after the case has been decided. Section 4. No member of the Court shall be a member of either the Executive or Legislative Branch of the Associated Students. ARTICLE 8 Qualifications, Elections and Tenure Section 1. Candidates for Election to office under this Constitution shall have the following qualifications: (a) the President. Executive Vice President, Legislative Vice President, Activities Vice President, and Financial Vice President shall each be an undergraduate who has at least 110 quarter hours of college credit at the time of his candidacy and shall have been in attendance at the College for at least one school year, (b) class officers shall have the official standing of their respective classes and be registered as full-time students, (c) representatives to the Student Senate and Executive Cabinet shall be bonafide members of the groups which they represent, (d) any student to be eligible to hold an Associated Student office shall have attained at least a 2.5 cumulative grade point preceding the time of candidacy, except freshmen class officers. Section 2. Elections shall be conducted under the following rules: (a) candidates for Associated Student Offices and for senate membership shall be elected by secret ballot. These members, except for the freshmen class officers, shall be elected before the last six (6) weeks of the Spring Quarter. The Freshmen class officers shall be elected before the end of the first six (6) weeks of the Fall Quarter (b) members of the Student Senate representing councils of campus organizations shall be elected by the respective councils. Elections shall beheld not later than May 15, (c) all members of the Legislative, Executive and Judicial Branches shall be in office not later than two (2) weeks after classes begin in the Fall Quarter, unless otherwise provided for in the Constitution. (d) those voting for school senators shall vote only within the school in which they are enrolled with the exception of those students enrolled in Secondary Teacher Certification Program who may vote either in the School of Education or in the School of their respective academic majors. Section 3. Tenure of office shall be limited to a single year, June 1, to May 31. (a) the officers of the Associated Students, presidents of Associated Men and Women Students, and the class officers shall hold office from June 1, to May31, (b) the remaining members , of the Legislative, Executive, and Judicial Branches shall hold office from the time of their election or appointments until the close of the Spring Quarter, except that no term of office shall begin before June 1, (c) in case of vacancy, except of the President of the Associated Students who shall be succeeded by the Executive Vice President, vacancies shall be filled as follows: 1. Any office of the Executive Cabinet shall be filled within three (3) weeks by special election or appointment as deemed necessary by the Senate. 2. The Senate shall have the power to determine whether the vacancy of an office needs to be filled and shall fill the vacancy accordingly. 3. Any vacancy shall be filled by the procedure as prescribed for that office. ARTICLE 9 Impeachment and Recall Section l. Any elected officer not maintaining the cumulative grade point average of 2.25 and previous quarter grade point average of 2.0 shall forfeit his of fice. The Associated Students legal advisor shall enforce this action. , New elections shall be held in the three-week period following the date of forfeiture. Section 2. Any elected officer of the Associated Students may be subject to recall by a petition signed by 10 per cent of the Associated Students. This petition shall be presented to the Student Court for legality, then presented to the presiding officer of the Executive Cabinet, except in the event that the President is subject to recall in which case the Executive Vice President will receive it. Within one week the person subject to recall may request the President to call a meeting of the Associated Students which request must be filled within one week after the presentation of the petition. Upon receiving the request, the President must call this meeting within ten (10) days at which time the accused shall be entitled to be confronted with the accusers and offer testimony in the defense of the charges against him. Thereafter an election of the Associated Students will determine the outcome o f the recall. ARTICLE 10 Amendments Section l. Proposals to amend this Constitution shall, except as provided in Section 2, originate by an authoritative vote of the majority of the Senate. The President of the College shall then appoint a committee of three members of the faculty to confer with a like number from the Senate, appointed by the President of the , Associated Students. With four members of this committee's consent, the.proposal shall be reported to the Senate for two-thirds majority agreement. When this is obtained the text of the proposed amendment shall be published once in the next available issue of the college newspaper in its original and amended form Within fifteen (15) days of its first publication, the Senate shall submit the proposed amendment to the members of the Associated Students in a special election for ratification. The Student body President shall certify the election and the Constitution shall be amended if such proposal receives a majority of votes cast in such a special election. Section 2. Proposals to amend the Constitution may also be initiated by a petition filed by fifty (50 ) students which shall be presented to the Speaker of the Senate for presentation to the Senate. ARTICLE 11 Campus Organizations Section l . Campus organizations must be approved according to the statutes as adopted by the Senate. Section 2. Any organization composed of college students which uses the name or facilities of the college is a campus organization and is subject to regulation by the Associated Students. ARTICLE 12 Ratification Section l. This Constitution shall become effective upon its adoption by the majority vote at a special election of the Associated Students. Section 2. All by-laws, rules, regulations and policies existing under the former Constitution are to remain in force until supplanted by new legislation, unless contradictory to this Constitution. |
