Show SIGNPOST ; Poge 7a November 17, 1967 ARTICLE VII Judicial Brunch Section 1. The responsibility of the Judicial Branch shall be to interpret the Constitution, determine constitutionality of legislation, and perform any other judicial functions of the Associated Students. Section 2. The Judicial Branch shall consist of the following: (a) The Supreme Court which shall consist of four Supreme Court justices appointed by the Executive Cabinet and approved by the Senate and a Chief Justice appointed by the President of the Associated Students and approved by the Senate. (b) Such lower courts as the Supreme Court deems necessary subject to the approval of the Senate. (c) An advisor appointed by the President of the College who shall serve without vote. This person shall not be an advisor to the Legislative or Executive Branch. Section 3. Questions or disagreements as to constitutionality, legality, jurisdiction, or non-performance of constitutional or statutory mandate, must be referred to the Court by the Legal Advisor upon his own initiative or upon receipt of any written request for a ruling of the Court Reasons for decision must be rendered in writing and given to the parties concerned within two weeks after the case has been decided. Section 4. No member of the Court shall be a member of either the Executive or Legislative Branch of the Associated Students. ARTICLE VIII Qualifications, Elections, and Tenure Section 1. Candidates for Election to office under this Constitution shall have the following qualifications: (a) The President, Executive Vice President, Legislative Vice President, Activities Vice President, and Financial Vice President shall each be an undergraduate who has at least 110 quarter hours of college credit at the time of hiscandidacy, and shall have been in attendance at the College for at least one school year. (b) Class officers shall have the official standing of their respective classes and be registered as full-time students. They must retain a full-time status during the term of office. (c) Representatives to the Student Senate and Executive Cabinet shall be bona fide members of the groups which they represent (d) Any student to be eligible to hold an associated student office shall have attained at least a 2.5 cumulative grade point preceding the time of candidacy, except freshmen class officers. Section 2. Elections shall be conducted under the following rules: (a) Candidates for Associated Student offices and for Senate membership shall be elected by secret ballot. Thesemembers, except for the freshmen class officers, shall be elected before the last six (6) weeks of the Spring Quarter. The freshmen class officers shall be elected before the end of the first six (6) weeks of the Fall Quarter. (b) Members of the Student Senate representing councils of campus organizations shall be elected by the respective councils. Elections shall be held not later than May 15. (c) All members of the Legislative, Executive, and Judicial Branches shall be In office not later than two (2) weeks after classes begin in the Fall Quarter, unless otherwise provided for in the Constitution. (d) Those voting for school senators shall vote only within the school in which they are enrolled with the exception of those students enrolled in Secondary Teachers Certification Program who may vote either in the School of Education or in the school of their respective academic majors. Section 3. Tenure of office shall be limited to a single year, June 1, to May 31. (a) The officers of the Associated Students, presidents of Associated Men and Women Students, and the class officers shall hold office from June 1 to May 31. (b) The remaining members of the legislative, Executive and Judicial Branches shall hold office from the time of their election or appointments until the close of the Spring Quarter, except that no term of office shall begin before June 1. (c) In case of vacancy, except of the President of the Associated Students who shall be succeeded by the Executive Vice President, vacancies shall be filled as follows: 1. Any office of the Executive Cabinet shall be filled within three (3) weeks by special election or appointment as deemed necessary by the Senate. 2. The Senate shall have the power to determine whether the vacancy of an otficeneedstobefilled and shall fill the vacancy accordingly. 3. Any vacancy shall be filled by the procedure as prescribed for that office. ARTICLE DC Impeachment and Recall Section 1. Any elected officer not maintaining the cumulative grade point of 2.25 and previous quarter grade point of 2.0 shall forfeit his office. The Associated Students legal advisor shall enforce this action. New elections shall be held in the three-week period following the date of forfeiture. Section 2. Any elected officer of the Associated Students may be subject to recall by a petition signed by 10 per cent of the Associated Students. This petition shall be presented to the Student Court for legality, then presented to the presiding officer of the Executive Cabinet except in the event that the President is subject to recall In which case the Vice President will receive it Within one week the person subject to recall may request the President to call a meeting of the Associated Students which request must be filled within one week after the presentation of the petition. Upon receiving the request the President must call this meeting within ten (10) days at which time the accused shall be entitled to be confronted with the accusers and to offer testimony in the defense of the charges against him. Thereafter an election of the Associated Students will determine the outcome of the recall. ARTICLE X Amendments Section 1. Proposals to amend this Constitution shall except as provided in Section 2, originate by an authoritative vote of the majority of the Senate. The President of the College shall then appoint a committee of three members of the faculty to confer with a like number from the Senate, appointed by the President of the Associated Students. With four members of this committee's consent the proposal shall be reported to the Senate for two-thirds majority agreement When this is obtained the text of the proposed amendment shall be published once in the next available issue of the college newspaper in its original and amended form. Within fifteen (15) days of its first publication, the Senate shall submit the proposed amendment to the members of the Associated Students in a special election for ratification. The Studentbody President shall certify the election and the Constitution shall be amended if such proposal receives a majority of votes cast in such a special election. Section 2. Proposals to amend the Constitution may also be initiated by a petition filed by fifty(50) students which shall be presented to the Speaker of the Senate for presentation to the Senate. ARTICLE XI Campus Organizations Section 1. Campus organizations must be approved according to the st i as adopted by the Senate. Section 2. Any organization composed of college students which uses the name or facilities of the college is a campus organization and is subject to regulation by the Associated Students. ARTICLE XII Ratification Section 1. This Constitution shall become effective upon its adoption by the majority vote at a special election of the Associated Students. Section 2. All by-laws, rules, regulations, and policies existing under the former Constitution are to remain in force until supplanted by new legislation, unless contradictory to this Constitution. it L " A J - ... 1 X'' y k J- it M -MUM ' """"Ste.. The revised Constitution was approved Wednesday by the I5-member Senate. Senators made a few changes In the Constitution which was submitted by the 1966 Constitutional Convention Committee. WSC Senate ratified the changes The revised Constitution was ratified Wednesday by the student Senate after two weeks of discussion and of making several changes submitted by the Constitutional Convention Committee. Students will vote Wednesday on the revised Constitution from 8 p.m. to 2 p.m. at several polling places on campus. Dennis G. Helner, Senate president, said the Constitution was unanimously approved by the 15 Senators. Members of the Senate Include Steve Young, AMS president; Helen Draney, AWS president; Trace Ferrin, freshmen class president; John Hansen, sophomore class president; Eddie Allen, junior class president; Dennis DeBoer, senior class president; Judy Will-more, Senator-at-large; Tom Welch, Senator-at-large; Bonnie Robertson, Residence Hall Senator; Hub Mehnert, Senator of school of Business and Economics; Ralph Klomp, school of arts, letters and science Senator; Dave Evans, school of education; Neil Robinson, school of Technical Education; Ron Ray, Inter-fraternal Council Senator and Dennis Helner, legislative vice president. Young Is chairman of the Senate screening committee. AH matters of business are reviewed by his committee to determine if such matters require Senate action or can be handled through other organizations.AWS president HelenDraney recently joined the Senate when Cathy Clay, former president, left school. "I'm glad to see the Senate has done a really serious and good job In revising the old constitution to meet the campus needs," Miss Draney said. Ferrin, the only freshmen student to be a member of the Senate, agreed with Miss Draney. "I represent half the freshmen class and would really like to get them Interested in student government," he said. In addition to serving on the Senate, sophomore pres. Hansen also works with the sophomore council in planning activities such as the "Orchid Ball," in January. Pres. Allen of the junior class also heads a junior class committee which sponsored a patriotic program at Mt. Ogden Park during the first weeks of school. Senator DeBoer, senior class president, helped the four classes to build a "class float" for the recent "Homecoming Parade". The float was the first to be sponsored by the classes since 1962. Working together asSenators-at-large are Miss Wlllmore and Welch who represent the entire student-body not individual academic schools. Welch is a member of the leadership committee, elections committee, and is president of the Pre-Law Club. He is alsopres-ident-pro-tempe of the Senate, "the Senator-at-large get to know what the people they are representing through a sounding board. I also worked on the constitutional convention committee and know pretty much what students want," he said. Miss Wlllmore, also president of LaDianaeda, said her job has shown her "that Weber State has lots of opportunities and will be able to grow In the future." The Residence Hall Council Is represented on the Senate by Miss Robertson, who is also a member of the Student Government Committee. She was appointed from 350 residents living at the three WSC dormitories. Senator for the School of Business and Economics is Mehnert, from Bremen, Germany. He serves with Klomp, Robertson and Evans, representing the academic divisions of the school. "Weber State College has the best curriculum this state has to offer in my field and I'm quite proud to represent the students," Robinson said. Actively serving on the Policy Committee, Robinson said, "the policy committee reviews actions of groups and organizations in making sure the college policies are understood and not violated." "Senate meetings are open to all Weber State College students and participation is Invited," said Klomp, who is a sophomore majoring in pre-dentistry. Evans said he was "honored to serve as Senator." Inter-Frat Council Senator Ron Ray said his duties at the Senate "helps li working with the student leaders and the sororities and fraternities in working together."
