RESOLUTION NO. 84-375 UINTAH AND OURAY AGENCY FORT DUCHESNE, UTAH WHERAS, the Ute Indian In-dian Tribe Fish and Wildlife Advisory Board of the Uintah and Ouray Indian Reservation, having hav-ing made due and thorough investigation and receivd recommendations recommen-dations from Tribal Fish and Wildlife personnel find that certain rules and regulations are necessary for the conservation conser-vation and wise use of fishing resources on the Uintah and Ouray Reservation; Reser-vation; and WHERAS, the Board has promulgated and suggests some rules and regulations governing the angling, camping, and boating on the reservation reser-vation for the 1985 season; and WHERAS, the Business Committee of the Ute Indian Tribe has reviewed the proposed rules and regulations and find it is in agreement with the same. WHERAS, United States v. Felter, Case No. CR81-O0G8J (U.S.D.C. Utah, Slip, Op of May 20, 1982) held that those persons per-sons terminated from the Ute Indian Tribe of the Uintah and Ouray Reservation, Reser-vation, Utah, pursuant to the Act of August 27, 1954, 68 Stat. 868, retained retain-ed a pro-rata share of the hunting and fishing privileges of the Tribe equal to 27.16186 percent of the takeable wildlife of the Reservation; and WHERAS, the above cited decision controls, despite the contrary view of the Tribe, the issue of Affiliated Ute hunting and fishing until such time as the Ute Indian Tribe is successful In its efforts to overturn Ihe same; and WHERAS, subsequent to such decision the Ute Indian Tribe Fish and Wildlife Advisory Board, by Resolution No. 84 06 of 19 November 1984, recommended rules and rrgulal ions for Ihe angling angl-ing of fish by both members and non-members non-members of the Ute Indian In-dian Tribe, including the angling of said fish by terminated members of the Tribe, hereinafter Affiliated Af-filiated Utcs; and WHERAS, those recommended rules and regulations governing the fishing permits represent a (air division Ol available fish between memlTrs of the Trile and Affiliated Utes in conformity with United Males V. Felter, Supra.
