The case of Ephraim Nash vs. Scofield Bros., the plaintiff suing for $2,500 damage through misrepresentation of slit-e- sold by defendants, was tried and submitted to the jury, w ho, after an hour's absence, returned, stating they had failed to agree. The jury stood 10 to 2. They were sent back to try again for a verdict. Provo, Nov. 8. p DUG G INS SENTENCED. This day being set for the sentence of S. M. Duggins, convicted of having maintained a gambling house on the second lloor of the Diamond saloon, the attendance in court was somewhat larger than common. Mr. Saxey, for the defense, argued a motion for a new trial on grounds of having proceeded under a wrong section of the statutes. King, for the territory, maintained that the suit was brought under two sections. The motion of the defense was overruled and Duggins was called up for sentence. The judge in pronouncing the same, stated he had been informed that a similar case had formerly been brought against the prisoner which would iniluence a stronger sentence on this one. The crime was regarded by tbe judge us very dangerous to the welfare of young men and corrupting to all classes. The sentence of the court was that defendant pay a fine of $200 and costs of the prosecution besides being confined in the county jail for a term of one month. Mr. Saxey asked that a bond be allowed the defendant for a stay of judgment in both fine and imprisonment pending appeal and ten days be allowed on which to give notice.
