Bennett Monday joined as of a bill requiring the lederal government to comply with state water rights, and requiring the government to pay for water taken under state laws. (R-Uta- co-spon- h) The bill also gives the federal government authority to obtain water by condemnation proceedings if necessary for conduct of federal programs. It was introduced by Senator Frank Moss Unlike a previously introduced bill, S. 851, which applies only to the Western reclamation states, this bill will apply to all states, Senator Bennett said. In effect, this bills says that If Congress authorizes a federal project which requires the use of water, 'the government must comply with state water laws, just as a private concern would have to do, in obtaining that water, Senator Bennett said. Of course, if it becomes necessary for the government to condemn the water under court action, this can be done but the federal government will have to pay fair compensation in such cases." Senator Bennett said the need for such legislation has been felt for many years, but that the Santa Margarita case has highlighted the need for such a bill protecting water rights. The controversy over rights to water in the Santa Margarita River began during World War II, when the federal government purchased the Santa Margarita ranch as the site for Camp Pendleton, a Marine Corps base. At that time, the ranch was not irrigated, and the question soon arose as to what water went with the land. Beginning in April, 1958, the Justice Department began serving summonses to thousands of landowners and water users m that area of California, demanding that they discontinue the use of water rights which had been established for many years under California laws. No compensation was offered to those who were being asked to give up their water rights. The injustice of this kind of federal action by an government can best be appreciated by the people of the West, to whom land is often useless without water for irrigation, Senator Bennett said.
