and the death penalty imposed on him were invalid and contrary to law Tomoya Kawakita filed his brief before the Supreme Court last week The case is to be argued before the high tribunal in Washington April Kawakita has steadfastly denied that he committed any of the acts allegedly in the indictment His attorneys have raised several points They argued that the Nisei could not be guilty of treason because of his citizenship status The attorneys held he lost his citizenship in 1943 when he entered his name in his unclefamily register traveled to China onJapanese passport bowed to the East in the mornings and prayed to the Emperorhealth and success in the war Healso had his status changed in police records in Japan from that of an enemy alien to Japanese national Kawakita 30 was convicted in 1948 on charges of brutality to American prisoners of war held inJapanese camp where he was employed during the war He was arrested in Los Angeles when he returned to this country after the war He was recognized byformer POW and convicted on the testimony of numerous POWs The Kawakita brief holds that even if he did lose his United States nationality he was neverthelesscitizen of Japan and subject
