The intent of the framers of the Constitution was to provide maximum liberty. Maximum liberty means minimum tyranny. One body would make the laws, another would administer them, and another would judge them. No division of government was meant to ever perform the functions delegated to the others. The fact that this was the intent was clearly expressed by George Washington in his Farewell Adress: It is important likewise, that the habits of thinking in a free country should inspire caution in those entrusted with its administration, to confine themselves within their respective constitutional spheres, avoiding in the exercise of the powers of one department to encroach upon another. The spirit of encroachment tends to consolidate the powers of all the departments in one, and thus to create, whatever the form of government, a real despotism.... One legal reference states this principle as follows: The principle of separation of powers of government operates in a broad manner to confine legislative powers to the legislature, executive powers to the executive department, and those which are judicial in character to the judiciary....(16 Am Jur 2d Sec. 210) And: Under the principle of separation of powers, it is settled that the legislature may not confer judicial functions upon members of the executive branch of the government; ministerial officers are incompetent to receive grants of in judicial power from the legislature, and their acts attempting to exercise such powers are necessarily nullities. (16 Am. Jur 2d Sec. 210) The above makes it very clear that one branch of the government is not to exercise the function of the other. Yet, it is a common thing today, and it is being done by usurpation and is completely illegal. Examples of government agencies that write the laws, administer them, and judge them that accuse, judge and fine the citizens without due process of law are the Internal Revenue Service and the Department of Labor as it administers, among other things, OS HA (the Occupational Safety and Health Act).
