Reese Hunter Editors Outlook Zoning Laws Violate Rights The more the citizens are confronted with the evils of the zoning system the more they find that once again, the politicians have taken them for a ride. Step by step, we citizens have allowed the government to gain control over our property until we suddenly find ourselves in the ridiculous situation of Ray T. Jacobs of Idaho Falls (Story on page 1). It appears that nothing short of putting him out of business will satisfy the insatiable appetite for power which seems to grip men when they have been given a little authority. The whole zoning program, including the Master Plan (which zones and therefore controls all property within the state) is a gigantic hoax foisted upon the people. When this was first passed the fear technique was used once again to successfully sell the people on the idea of letting politicians control their property rather than themselves. The people were asked such questions as, What if your neighbor built a pig pen next door to you? Or, What would you do if your neighbor built an apartment building next door? With these scare tactics used as arguments we the people gratefully put our heads in a far worse noose and hoped for a better world to come of it. Today, zoning is a farce. Zones can be changed at the whim (and possibly under the table payments and bribes) of politicians. We have not been given the protection that was promised. All that occurred when we allowed zoning and Master Planning to come into our lives was to transfer the control of our property out of our hands and into the hands of politicians thus giving them the power of arrogant domain over our property. This has been a grand mistake for which all of us and our children will pay a great price. Until we get rid of the disease of collectivist thinking that has permeated the citizens of this nation we are destined to be enslaved and at the mercy of our public servants turned masters. While you apathetically ignore the activities of your city and county, mayors and commissioners are heeding the clarion call of Housing and Urban Development (HUD) programs to exercise complete control of all land in the United States. HUD has billions to spend and will provide funds for all kinds of projects if the city and county fathers will only follow the guidelines. What are some of these guidelines? Number one is a Master Plan for every county in the United States. Any serious search at county headquarters will provide you with a copy of that plan, which includes the zoning of all areas into different classifications such as, business, residential, recreation, manufacturing, farming, and perhaps others. For this master plan the county fathers go through a prescribed procedure of showing they have complete support of the citizens. They hold meetings where they control procedure, choose wrho attends, and then report in the press the unanimous support of all present. Later on, they proceed to pass ordinances under this false banner, proclaiming complete public support. One of the first steps is to tighten up the zoning laws and to put stiff restrictions on building codes. Then they start to enforce the restrictions to bring compliance, for they want the next HUD grant. HUD, in the meantime, is going about its work of promoting the destruction of property rights by insisting that all new programs meet the requirements of the Master Plan. Note the following quotations from a 1963 publication of the Salt Lake County Planning Commission which illustrates the fact that the master planners intend to force you to use your property as they see fit: There is an unusual amount of land in Salt Lake County devoted to nonconforming uses, and . . . the maximum utilization of the lands of the County requires the elimination of these nonconforming uses. To this end, it is recommended that use be made of the provision of law allowing the elimination of nonconforming uses upon order of the zoning authority. . . . Upon sale of land devoted to a nonconforming use, the right to continue the nonconforming use should thereupon cease and terminate. To deprive you of the use of your property as you see fit is unconstitutional. The Constititional guarantees to be secure in your person, e laws and property, and effects takes precedence over any are the supreme laws of the land . We do not believe that City and County Hall are a fountain of all wisdom in zoning and the records indicate that the proper amount of cash in the right hands can get a predatory businessman, a politician, or a big campaign supporter the zoning he wants. Many collectivists and government bureaucrats believe in the goals of Karl Marx wherein the government controls the people by controlling all the land. Supplement-Confiscatio- n If you have not read these pamphlets, I feel that you will find them to be interesting and worth the time it may take you to get copies from Kennecott and read them. As you know, El Teniente is the Chilean copper mine that was developed by Kennecott in 1906. While it is natural for us to assume that Kennecott has prepared these papers to show itself in the best possible light, I feel that the objective evidence found in these papers is overwhelmingly in favor of the idea that Kennecott and the American people have been cheated.
