Since tbe penalties for violation of most of tbe sections in Title 26 USC call for Imprisonment or Fine or both tbe defen- dant argues that Title 26 . USC is nothing more than an additional Criminal Code supplemtnary to Title 18 USC and therefore tbe Miranda Options should appear on all IRS tax returns, notices of seizure and other forms requiring information from tbe public , and whenever a private citizen is approached by IRS agents for tbe purpose of determining tax liability, or for seizure, or tbe production of records, private and ' corporate, or any other official business that said agents should be required to recite the Miranda warning. Such a warning was never given to defendants by above agents. This is not the time or place to elaborate in detail on the above arguments as they are arguments that should have been beard and debated in open court at a Preliminary Hearing in order to determine probable cause. The defendant contends that be was acting in defense of bis inalienable rights and tbe Supreme law of the land. A determination of defendants contention should be made long before tbe defendant goes to trial where be would then be in jeopardy of bis liberty and bis property. Tbe testimony presented to tbe Grand Jury on December 7 & 8, 1971 was insufficient and did not . meet tbe demands for justice. Tbe Grand Jury was prevented from performing its true function of being allowed to run down every clue and ask questions of every witness in every proper way to find out if a crime bad been committed, and to charge tbe proper person or persons with tbe commission thereof. (See U.S. v. Collins supra) Wherefore defendants motion before this court to remand indictment should be upheld. |
