UTAH W PHONE (801 V -- ) 486-967- 1 84115 Internal Revenue Agents, smilingly displayed a court order informing him that assault and battery and other charges stem- ming from the seizure attempt have been dropped. The order was signed by Daniel A. Alsup of the U.S. District Court and was dated November 18, 1971. Grismore was approached at his home September 20th by Internal Revenue agents who attempted to seize a 1969 automobile without a seizure warrant issued by a court. After examining the levy and seizure notices ex ecuted on Internal ; John Grismore displays paper indicating that assault charges were dropped. against Grismore for assault. A separate complaint was also signed against Grismore and his father-in-laJennings B. Smith, for forcible rescue of seized property and warned them they would be prosecuted for trespassing if they refused to leave. Davis County police were called by Mrs. Grismore and officers were dispatched to the scene where they temporarily took the IRS agents into custody until authorized by county attorney, them. w, property, resulting from release - After leaving the Grismore property, one of the agents, Mr. Ronald P. Harrington, came back on the property and nudged Mr.. Grismore across his own carport. Even though witnesses observed the incident, the,, following day Mr. Harrington filed complaint ' j.. The physician has issued orders that Smith is not to be questioned, written to, or contacted in any manner by government authorities concerned with this case. Asked how he felt about the charges being dropped against him, John Grismore stated: Naturally I feel good about the ' charges being dropped, however, from correspondence I have received from the U.S. attorney, it appears that the government now wants to take me before a grand jury. Mr. Smith was taken into custody three days later by IRS agents who, according to Smith, were rough with him. Smith had been in the hospital three weeks earlier because of a serious heart attack. While enroute to the Salt Lake County jail with the two IRS agents, the seventy-year-o- ld Mr. Smith had a heart seizure and was denied entry to the jail because of his physical condition. According to the Federal Rules of Criminal Procedure, a man has a right to a pretrial hearing once he has been taken into custody and there are some advantages to be gained by such a hearing. For one thing, it is public, and I want the public to know what the IRS is doing to enforce collection of taxes without due process of law.
