Thus, we have now established that a principal has the right to change his agents for other agents who will be loyal to him, and we have established that all of our elected and appointed officials provides for removal of appointed officials. This objection is without merit if you remember that the number of appointed officials decision-makin- g major filling positions has increased are agents and representatives of the people. The purpose of the Utah Recall Law is to change the way in which elected and appointed officials in Utah may be removed from office and replaced by other elected or appointed officials, at the pleasure of the people. Some opponents of the Utah Recall Law have said that recall is not needed, and we can remove bad elected officials when their term expires and they have to seek reelection. The problem with this reason is that it assumes several things that are not true, as follows: 1 . That the electors are well informed of all relevant actions taken by their representative, eten those which involve no publicity, 2. That the electors will have total recall and will equate actions they consider good with actions they consider bad and make a of their balanced judgment representatives actions, 3. That the weight of bad over good actions by an elected or appointed representative will automatically work to force a bad official out of office. In contradiction to these assumptions, I am convinced that many important committee actions taken by members of the legislature are unknown to constituents, that appointed officials are capable of many actions which might be very distasteful to a majority of citizens but they cannot be removed by the citizens, that the electors do not have total recall and tend to give bad officials the benefit of the doubt after the passage of time rather than asking that justice be done. Another argument says that the opponent of the law is not really opposed to recall, but the Utah Recall Law requires too small percentages to initiate recall. Such an argument is totally subjective, because the argument on precen-tagcan range all the way across the range from zero to 100. Because the range can be any percentage from 0 to 100, if we are to resolve the proper percentage here today we would have to assume that one of us is in favor of zero percent to initiate and the other in favor of 100. But, this is not the case. I feel sure that those people who feel the recall idea is all right or good would not demand that 100 of the electors in a district have to sign an initiative petition to recall. In closing, I conclude that you can vote for or against the Recall Bill because of bias or prejudice or you can vote for or against it because of objective facts. But a major point to remember is that, in spite of what former President Nixon is said to believe about the definition of sovereignty in these United States, the basic laws of nation and state define the people as sovereign. I hope that all of you will vote for the Utah Recall Bill so as to clairfy this issue for everyone.
