When any sober-mindperson analyzes the above statement, he will find it not only shocking but revolting. It is shocking to observe an appointed bureaucrat exercise the power to shut down an entire industry, if he desires. It is even more shocking to observe that such power, even though it is enforced by the power of the government, is not constitutional and therefore, not legal. In the first place, the Constitution is a grant of power from the people to the government, and the government has no legal authority other than that granted in the Constitution. And there is certainly nothing in the Constitution to give the F.D.A. or any other government agency the authority to dictate to the people what they may or may not use for food coloring. Furthermore, the Constitution guarantees to each citizen due process of law.
