since the affair the body of the victim was taken to his mothers house on sunday morning mrs stokes is said to be completely prostrated with grief over the sad fate of her son the coroners inquest was two bullet wounds in the left breast one through the wrist and another in the left shoulder it was supposed that ono shot had taken effect in the face but this proved to be erroneous the wound in the deris accounted for bythe fact that when the first shot was fired stokes had his left hand raised up and the ball after passing through the wrist lodged inthir shoulder apon the return of the jury to brother the deceased myself and several others were in williams saloon in the wasatch building we were fooling around at the time and who was also in the saloon said th at my brother had jostled up him they of the saloon into the liall way and some one said to me that man says he will fill your brother full of holes I 1 went out into the hall way immediately and taking hold of asked him if he was the mancho was going tado the shooting A general scuffle followed and stokes was arrested I 1 did not see him in the hall way at all after the arrest I 1 suggested going up the street and we had just started when the shots were fired I 1 only heard two shots I 1 heard in the saloon that had put his hand behind him two or three times as though to draw a pistol amos marsden a brother to the preceding witness waa cheif called he said A number of us were in williams barrans Gar rans saloon on saturday night and my brother and my sol cooling and I 1 may have bumped ap against accidentally occurred he stated positively that he saw the pistol in namye hand james marsden was recalled re called and stated that he did not know what stokes was arrested for th question was put to all the witnesses bul none could answer officer malin testified I 1 was standing when the shooting occurred and stokes was mat falling to the floor I 1 grabbed bench who said 1 did not do it there is theman while thus engaged franks and had taken to the prescription desk I 1 went d own to renew the search when franks pushed my hands away I 1 told him the man could not loave until the pistol had been found and he then said that he had it officer said be was standing near the comer when the shooting occurred and was in the store within a few seconds he turned the body over and searched it but found no weapon andaas going to search mc mannary when told him that they had the man in charge and ordered him to keep his hands off it was expected that deputy marshal rench would be unhand to testify but owing to a misunderstanding as to when the inquest was to be held he had gone down to mrs stokes the jurors were consulted and as they thought it essential to have his statement an adjournment was taken until 6 p m upon to assembling at 6 deputy marshal bench was present and testified as follows I 1 was walking up main street at about 9 on saturday night and upon reaching the wasatch building heard some kind of a row in the hall I 1 went ux and saw three or four men there two of them were scuffling as I 1 went in to part them and while thus en the deceased caught me by the throat and began choking me came to my assistance stokes was quite a powerful man and very quick he pushed ecman namy with his shoulder but did not strike him after getting him under control I 1 started out and told him that he was resisting an officer he struggled considerably but some one came up and said I 1 was a deputy after which he walked quietly along commissioner norveil who wag also present told to go along and assist me upon reaching tho street north of tho wasatch building however I 1 ordered him to go back and supposed he did when they were nearly to the drug store stokes asked me what I 1 was boing soing to do with him I 1 replied that would take him to the city hall he said he did not want to be disgraced and to avoid trouble I 1 took him in smiths drug store with the intention of
