Daniels is the eon of former residents Aaron and Cindy Daniels and Linda and Richard Mather. He is the grandson of Neola residents Gene part-tim- e and Lama Daniels. The senior at Marcos de Niza High School in Tempo has been named National SADD Student of the Year for hie involvement in Students Against Driving Drunk. Its the first time an Arizona teen has won the award. Daniels joined the SADD chapter at Marcos three years ago. He since has donated more than 700 hours to the fight to curb drunken driving. In addition to organizing SADD events at school, Daniels has lobbied the Legislature for a lower limit, spoken on radio panels and at conferences, served on the state organizations board of advisors and assisted stings. police in underage-buyin- g The national title comes rith a $500 scholarship and the chance to represent SADD across the country. Darnels also serves as the LDS Seminary President for his high school this year. He carries a 4.03 grade average. Open to all high school juniors in the state, students were with finalists interviewed and selected by a panel of judges. He has given many presentations throughout the state and has written materials and developed videos for use by parents and teachers. (Utah law also provides for a special power of attorney to make health care decisions for a person who is unable to communicate her own decisions). A very common form of power of attorney is the Durable Power of Attorney, which takes effect . upon incapacity of the person naming the power. The Durable Power of Attorney was intended to provide financial management for a person who is incapacitated: it does not create the legal authority to make other important personal decisions - like where, a person is to live and with whom they may associate. Those rights can only be taken away by due process of law in Guardianship or Commitment proceedings. Over and over, we at legal services and others who work with senior citizens. Adult Protective Services, and the Long Term Care Ombudsmen, encounter persons who are in nursing homes who do not warn to be there. Typically, a family member or friend has obtained a durable power of attorney, checked a perron into a nursing home and then sold the home. Unless the incapacitated perron has agreed to this plan (and some elderly perrons may agree and then forget), it is utterly proceedings in a court of law. There are sound reasons for these due process rights. There are probably no more basic and dear fundamental rights in our legal system than the rights to privacy and personal choice with respect to residence and association. Our courts have wisely determined that these rights may rally be taken away by a showing of dear and convincing evidence that the person is not longer capable of a rational decision making process. Of course, family and friends do not want to drag auntie poor ol through a humiliating court procedure - they would rather just manipulate and buffalo her into thinking she has no choice. I do not think this approach is fair, honest or respectful of elderly persons. I think they have the right to remain at home and have their assets and income used to support them in their home as long as that is their choice. Guardianship proceedings are now very reasonable.
