H. Kerr, director of the Property tax division of the State Tax Commission. Prior to this time, fractional interest owners of oil properties were receiving valuation notices and tax notices relating to their fractional Interest In property being operated by a unit operator. Beginning with the 1966 assessment, the entire unit is being assessed to the operator, who In turn Is privileged to collect a proportionate amount of tax from each Individual owner, normally as a deduction from royalties. "Where oil, gas or other hydrocarbon wells or fields belonging to multple owners are operated as a unit, the owner of each fractional Interest in such units will be liable for the same proportion of the tax assessed against the total unit that his Interest therein bears to the total of Interests In such Reads a portion of unit. U. C. A. 1953 Section as amended. The unit operator, however, Is responsible to collect from the owner of each fractional Interest and remit the tax assessed against the entire unit. The owner shall also file the statement for the entire unit. The tax commission may require the Inclusion in this statement of a listing of all fractional Interest owners and their Interests. The operator shall be notified of the assessment against the entire unit as provided In the law. In the event of failure of the unit operator to collect from the fractional Interest owners and remit the tax a penalty shall be imposed against such operator by the county treasurer for the county In which the unit is located In the amount of the tax due and owing the county for the tax period in question. 59-5-- 65 .... lb.
