Show Reflections, May SI, 1984, Page 3 Enforcement Of Pension Plan Law Nets Utah Workers $181,000 Nearly $181,000 in employee pension and welfare benefit plan funds were recovered for workers during fiscal year 1983 by enforcement actions under the Employee Retirement Income Security Act (ERISA) in Utah, according to the U.S. Dept, of Labor. In addition to the restored assets, department actions also resulted in the reversal of more than $2 million in prohibited transactions involving pension and welfare benefit plan assets of 227' Utah workers, the department said. While ERISA does set standards for employers who hae private pension plans, it does not require an employer to establish a plan. The department said most of the funds in Utah were recoverd and most of the transactions were reversed through voluntary compliance agreements between the department and various pension and welfare benefit plans. Under ERISA, workers must be allowed to participate in employer-sponsorepension plans without having to meet unreasonable age or length of service requirements. Generally, workers must be allowed to participate in a plan where they have one year of service and have reached age 25. Plans that offer full and immediate vesting, however may require age 25 and three years of service. d Court Upholds Law Limiting Parental Rights A case involving the birth of a child to two Moab minors last week prompted the Utah Supreme Court to uphold as constitutional a state law which terminates the parental rights of the father of an illegitimate child if he fails to give swift notice of his claim of paternity. The law upheld unanimously by the justice says a person who is or claims to be an illegitimate childs father must file a notice claiming paternity prior to the date the child is relinquished or placed with a adoption agency. The case involved two high school students. The boy was aware of the girls pregnancy. She left Moab to have the baby in Ogden and arranged with the Childrens Aid Society of Utah to relinquish the child to that agency for adoption. The child was placed in an adoptive home two days after its birth. Five days after its birth, the state verified to the adoptive parents that no father had come forward and the baby was theirs. Seven days after its birth the Moab boy filed his claim of paternity and sued for custody of the child claiming the mother and the state had concealed the infants birth. The lower court agreed but the adoptive parents and the adoption agency appealed. The top court said evidence showed the boy was well aware of the pregnancy and expected birth date but waited to file his paternity claim after the baby was born in an effort to ensure that it was indeed his. In upholding the law, the court said the states strong interest in immediate and secure adoptions for eligible newborns provides a suficient justification for significant variations in the parental rights of unwed fathers, who, in contrast to mothers, are not automatically idenfied by virtue of their role in the process of birth.
