Show SO THE PEOPLE MAY the report hag been circulate quite generally in river school re presen precinct no 3 thai J P miller and john W dalton the regularly nominated candidates tor school trustee from that precinct are not registered voters and are disqualified from voting it the school election on december 1 and hence i neither could qualify as member ot the school board if elected the facts of the matter are that both mr miller and mr dalton were duly registered to vote at the gener al election on november 2 mr miller ho weyer was seriously ill on election day and could not call at the polling place mr dalton was away from nome and attempted to vote by absent ballot but his ballot did noi reach the county clerk in time foi delivery to the judges of election in order to clear up any misunderstanding and at the request of friends of both mr miller and mr dalton the times independent has consulted competent attorneys who state unqualifiedly that both candidates are qualified to vote and either is qualified to serve if elected the gist of the law governing the matter follows section 2141 of the compiled laws of utah 1917 requires that every person to vote at a school election must be registered within the time and in the manner and form required for registration for voting in general section 2136 of the compiled laws of utah 1917 provides that prior to the time tor registering voters at each general or municipal elect loi the county clerk of each county ot the state shall prepare an official reg ister of voters this section further provides for all special and school elections there shall be no special registration of voters but the official register last made or revised shall constitute the official register for such special or school election from the foregoing it will be seer that the official register which will be used for the school election will be the same official register furnished in the respective voting districts for the general election the fact that a qualified voter did not exercise his privilege of voting at he general election does not in any stfan ner affect his right to vote in the school election and for that matter would not affect his registration or his right to vote in any special elec tion that might occur at any time prior to the registration for the general election two years hence the only effect his failure to vote at the general election would have would be to require that he register reregister re in order to vote at the next general election two years hence as the county cherl in biking up the official register prior to the registration for the gen eral election would not find his name on the polling list the only time the county clerk is required to make up an official register is immediately prior to ft general or town election t |
