Gibson City Recorder ORDINANCE NQ. 172 AN ORDINANCE CONFIRM ING THE ASSESSMENT ROLL AND LEVYING A TAX AND PROVIDING FOR THE ASSESSMENT OF PROPERTY IN CURB AND GUTTER AND SIDE WALK IMPROVEMENT DISTRICT NO. 4 FOR ROY CITY, UTAH, FOR THE PURPOSE OF PAYING THE COST OF CONSTRUCTING IMPROVEMENTS ON CEB TAIN STREETS WITHIN SAID CITY CONSISTING OF CURB AND GUTTER AND APPURTENANT DRAIN AGE FACILITIES SIDE WALK AND PRIVATE DRIVEWAY AND THE NECESSARY CONSTRUCTION INCIDENTAL THERETO, AND CREATING A SPECIAL IMPROVEMENT GUAR A ANTY FUND AND PROVIDING THE TIME WHEN THIS ORDINANCE SHALL BE COME EFFECTIVE BY BE IT ORDAINED THE ROY CITY COUNCIL OF ROY CITY, UTAH: Section 1. That the City Council of Roy City, Utah, hereby confirms the assessment roll as corrected and adjusted by the Board of Equalization and Review for Curb and Gutter and Sidewalk Improvement District No. 4 for Roy City, Utah, and hereby confirms the finding of the Board of Equalization and Review that the proposal lkts of assessments as equalized by the Board of Equalization and Review are just and equitable and has not Increased the amount of the proposed assessment against any piece of property and that no assessment list as corrected by the Board of Equalization and Review exceeds the benefit to be derived from the improvements by the property so assessed and that no piece of property listed in said assessment list will bear more than its proportionate share of the cost of such improvements. Section 2. That the City Council of Roy City, Utah, does hereby levy a tax and provide for the assessment of the same upon the real property shown upon said assessment roll in the amount of assessments listed therein and upon the real property hereinafter located within the described limits of Curb and Gutter and District Sidewalk Improvement No. 4 in and for Roy City for the purpose of paying the cost of constructing improvements .on certain streets within said city consisting of curb and gutter, sidewalk and appurtenant drainage facilities, private driveways, and such other necessary construction incidental thereto adjacent to the property hereinafter aescribed and abutting and fronting upon the following described streets in Roy City, Utah, CURB, GUTTER AND SIDEWALKS 1. 2050 West Street from 5300 South Street, south to the end of the dedicated street. (Both sides). 2. 2050 West Street from 5600 South Street to 5700 South Street (West side only.) 3. 5650 South Street between 2050 West Street and 2200 West Street (Both sides). 4. 5400 South Street from 2200 West Street to 2300 West Street (Both sides). 5. 2300 West Street from 5200 South Street to 5600 South Street (East side only). 6. 5600 South Street from 2700 West Street to a point 297 feet east from 2700 West Street (South side only). 7. 2100 West Street from 5500 South Street to 5600 South Street (East .side only). This tax shall be levied to defray the expense of constructing the improvements consisting of constructing; curb and gutter, sidewalk and appurtenant drainage facilities, private driveways and such other necessary construction incidental thereto upon all property, lots, pieces or parcels of land fronting or abutting upon or adjacent to to the d the streets full depth of all such property, lots, pieces or parcels of land and to defray the abuttors portion of the cost and expense thereof by local assessment upon the lots or pieces of land to be affected or benefited by said improvements fronting or abutting upon said streets within Curb and Gutter and District Sidewalk Improvement No. 4 of Roy City, Utah, a special assessment is hereby ordered and levied against and upon all property, lots, parcels or pieces of land fronting or abutting to said streets defray the expenses of constructing said improvements consisting of constructing curb and gutter, sidewalk and appurtenant drainage facilities, private driveways, and such other necessary construction incidental thereto in t: above-describ- above-mentione- above-ment-e- d above-mention- WHEN IT SIMMERS OUTSIDE..! -- i foil 1962 Curb and Gutter and Sidewalk Improvement District No. 4 for Roy City, Utah, adjacent to the treets and real property as described in this ordinance and it is hereby adjudged, determined, and established that said abutting and fronting property will be of land as front and abut the streets hereinabove described are hereby assessed at a uniform rate in accordance with the linear front footage upon said portion of said streets and to the entire depth thereof of said property, and the said tax is hereby levied and is to be assessed upon said abutting pieces and parcels of land in the total sum of $67, 343 55 and that the total tax is divided Into separate portions complying with toe improvements installed and assessed as follows: The total cost of the curb and gutter portion is $38,295.03, which amounts to an assessment rate of $2.38875 per front foot. The total amount of the driveway is $6,978.83, which portisn amounts to an assessment rate of $0.63501 per square foot of paving. The total driveway femount of the radius curve for driveways portion is $1,819.82, which amounts to an assessment rate of $8.50383 for each linar foot radius curb for each driveway. The total cost of the sidewalk portion is $20,249.87, which amounts to an assessment rate of $2.32624 per front foot for 4 inch sidewalk and $2.45295 per front foot for 6 inch sidewalk. Said assessment does not exceed the total costs of the improvement which includes the interest on interim warrants and the total contract price, plus an amount egual to but not exceedthereof to cover the ing 10 actual cost of engineering, inspection, publishing, and mailing notices and making the levy; and the City Treasurer of Roy City, Weber County, Utah, is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the purposes herein mentioned the property hereinabove and hereinafter described, and a tax is hereby levied to be assessed by said Treasurer upon all lots, pieces, or parcels of land to be benefited or affected by said improvements; said tax shall be upon the lineal front footage of said property, lots, pieces, or parcels of land to be benefited or affected by said improvements, except that the driveways will be assessed on a square foot or square yard basis and driveway radius curbs on the basis of total length of the radius curbs. All the land and real property within Curb and Gutter'and Sidewalk Improvement District No. 4 for Roy City, Utah, benefited by the improvements constructed in said District and affected by the tax and assessment levied for said District is located and situated within the following described real property boundaries: Beginning at a point on the South line of the City Limits 330 feet East of the East line of 1900 West Street and running thence West along the South City Limits to the' centerline of 2700 West Street; thence North along of 2700 West the centerline Street to the centerline of 5600 South Street; thence East along the centerline of 5600 South street to a point 330 feet West of the West line of 2300 West Street; thence North along a line 330 feet West of the West line of 2300 West street to the centerline of 5200 South Street; thence East along the centerline of 5200 South Street to a point 330 feet East of the East line of 1900 West Street; thence South to the point of beginning. Section 3. The assessment list made by the City Treasurer as corrected, approved, equalized and completed by the Board of Equalization and Review of tbe property described in Section 2 of this ordinance being included within Curb and Gutter and Sidewalk Improvement District No. 4 for Roy City, Utah is hereby confirmed and the assessments made and returned In said completed list and tbe report and recommendations d the Board of Equalization and Review to tbe said ordinance shall be published once in the newspaper of general circulation hi Roy City, Utah, and that this City Council of Roy City, Utah, ordinance shall take effect imare hereby ratified, approved, and mediately upon its passage and confirmed. approval and publication ns reSection 4. Said tax shall be payable in ten (10) equal yearly installments as provided by law and' ordinance, with interest on the whole sum unpaid at the rate of 5 per annum, payable at the time each installment is due, provided, however, that one or more of such installments in the order payable, or the whole tax, may be paid without interest within 15 days from tbe date this ordinance becomes effective. One or more installments in the order in which they become due, or the whole special tax, may be paid after said fifteen days and before the first installment becomes due by paying the same with interest front the date of levy to the'date such first installment is due. One or more installments in the order in which they are made payable, or the whole special tax, may be paid on the day any installment becomes due by paying the amount thereof and interest to date of payment. Default in the payment of any such installment or principal or interest when due shall cause the whole of the unpaid principal or interest to become due and payable immediately, and the whole amount of the unpaid principal shall thereafter draw interest at the rate of 10 per annum until paid, but at any time prior to the date of sale or foreclosure the owner may pay the amount of all unpaid installments past due, witty interest at tbe rate of 10 per annum to date of payment on the delinquent installments, and all accrued costs, and shall thereupon be restored to the right thereafter to pay in installments in the same manner as if default had not oc- curred. Section 5. The City Council of Roy City, Utah, does hereby create a special improvement guaranty fund and shall at the time of each annual appropriation ordinance, so long as any special impjovement district bonds of Roy City remain outstanding, provide tor the levying of a tax of one mill in each year to create a fund for the purpose of guaranteeing to the extent of such fund the payment of special improvement bonds or warrants and interest thereon issued against local improvement districts for the payment of local improvements therein, all in the manner and to the provided by Section Utah Code Annotated, 1953. Section 6. That the officials o! Roy City, Utah, be and they are hereby authorized and directed to take all action necessary or appropriate to effectuate tbe provisions of this ordinance. Section 7. That all ordinances or parts thereof in conflict with this ordinance are hereby repealed. After the bonds of said improvement district for Roy City, Utah, have been hereafter issued, this ordinance shall constitute a contract between Roy City and tbe bolder, or holders, of said bonds and shall be and remain irrepealable until said bonds and interest securing thereon shall have been fully paid, satisfied and discharged. Section 8. The City Recorder shall deliver to the City Treasurer a certified copy of the ordinance levying such tax and such Treasurer shall without delay give at least five (5) days' notice in one or more newspapers having general circulation in Roy City, Utah, of the time when such tax will become delinquent. Section 9. That an emergency is hereby declared, the preservation of the peace, health and safety of Roy City and the inhabitants thereof so requiring, that immediately after its adoption this shall be signed by the Mayor and City Recorder and shall be recorded in the ordinance book kept for that purpose and QUICKLY at This ' ...
