I circulated a letter of protest against the Recreation District myself. I did not tell people they would be paying taxes to support this, nor did I threaten little old ladies with eternally rough roads. We are the backbone of this county, or at least that is how I see it. j I am the member of a family who is currently raising its fifth generation in this county. If it were not for our selfish attitude, this county would not exist. We have supported this county with taxes for over . years. We helped build canals and culinary water the systems, the streets, public r100 buildings and recreational facilities that now exist. Our selfish support has kept schools operating, churches iopen and law enforcement When our economy was at an all time low and many people bailed out of this county, we still paid taxes and supported social services for those less fortunate. If this is selfish, we plead guilty. This kind of selfishness is representative of this V of the population. When is it someone elses turn to furnish something? I am continually amazed at the number of people who profess to know how the church functions in the state and in the community. In a decision dated Oct. 12, , I 1989, the board said that the BLM had acted illegally in fh granting the permit and affirmed the environmental f .groups contention that the common Utah BLM practice of accepting county claims of R.S. 2477 road rights-of-wawithout making a determination as to the validity of such claims, is unlawful. The BLM countered by saying it is not the function of the department to determine whether or not a public road was ever located y y, right-of-wa- c r ' 1 you can drive in the canyon prior to the repeal of the highway y statute R.S. 2477 in 1976. The board insisted that the BLMs position was in error and said was established prior to 1976, several affidavits have been produced by individuals who claim they have driven up the canyon, have seen vehicle tracks in the past, have moved some rocks or have used a horse trail in the canyon. The right-of-wa- exists. Confused? The R.S. 2477 law was enacted in 1866 and y established that the for the construction of highways over public lands, not reserved for public uses was granted. In other words, roads could legally be built on public land. The intent was to encourage the development of an adequate public highway system in the U.S. In 1976, the R.S. 2477 law was changed with the passage of the Federal Land Policy and right-of-wa- question is whether these activities are sufficient to Act.
