W. Keller which in substance declared Price city ordinance 1050 invalid. The matter arose in February of 1946 at which time three agents for the Utah Liquor Control commission entered the Price Lodge of Elks, No. 1550, without having first obtained a search warrant. The agents were then named in a complaint charging them with violation of the ordinance which allegedly guarded against unlawful searches and seizures. At a hearing before City Judge S. J. Sweet-rin- g two of the agents, Arno Stiniche and L. P. McGarry, were found guilty of ordinance violation. The third, Arzy Jaynes, was released from the complaint on lack of evidence. The liquor com- mission subsequently filed an ap- peal with the district court and Judge Keller upheld a demurrer to the complaint entered by attor- neys for the commission which in effect held the ordinance invalid. Price city then filed an appeal of Judge Keller's decision with the supreme court.
