The provisions of the code adopted, set up by any group and approved by the president, wail be binding not only upon the members of such trade organizations, but upon all others who come logically and naturally under that classification. When the majority of a certain group adopts a code of business ethics and standards, and approved by the president; or, when a standard code is established by the national agency for the government of any certain group in the event of failure of such certain group to adopt a standard code, such code as is applicable to that certain group becomes mandatory upon all businesses coming within the scope of that group, whether or not they are in accord with the provisions thereof. The bill provides further that there shall be no inequitable restrictions imposed upon any business for admission to membership in the trade association to which it rightfully belongs. The Wagner bill code will include such conditions as: Closing hours (uniform); selling below cost; cutthroat merchandising; unfair advertising; unfair competition; misleading signs; misleading advertising; unfair compensation to labor; or any other condition pertaining to the proper conduct of business. The codes adopted voluntarily, or laid down by the president for any group, shall be regarded as the rules and regulations that will control the policies of all industries relating to that group, and such codes are by the penalty of $500 for each offense. If any group fails to organize itself into a trade association, the president may prescribe a code for such industry. Such code will have the same force and effect as a code submitted by the industry itself. It should be remembered that in the past, we have observed that regulations drawn up by the government were much more drastic than any regulations that have been drawn up by the people or industries affected. Therefore, the necessity of drawing up a voluntary code of ethics by each group will be evident. Such codes have been, or are now in the course of being worked up, drawn up for the various trade groups of the state of Utah, about 20 different groups being represented, and these 20 codes will be in the state advisory board council and submitted to the president for approval. In this way, it is expected to obtain a more liberal code than if the president were to force a code upon business. It is expected, under the provisions of the bill, that the president will require business enterprises be licensed and the president is given the authority to suspend or revoke licenses. Any person or institution doing business without a license, or in violation of codes or conditions, shall be fined not more than $500 or imprisonment, or both.
