Higgins, district attorney of the Fifth Judicial district, seeking to restrain Judge Tkomaa B. Burton from proceeding farther with the ease against Frank P. Kelsey, who ia charged with mingling poison with water with intent to injure his mother, Eliza Kelsey, and others, was granted by the state supreme eourt returnable January Slat. Judge Burton had set trial fur today. The district attorney contended that the state was not ready for the ease. In his motion he alleged that Judge Burton had, on December 5th granted a ehange of place of trial from Washington county to Millard, and at the time, without consent of either counsel stated that the ease should be tried immediately, and that on December 6th Judge Burton, over the protest of the dutriet attorney, arbitrar ily set the case for trial on December 13th. In the motion the district attorney further states, in part : This affiant firmly believes that the only reason the said judge did not consult this affiant as an officer of the etate in order to determine whether the rase could or shall be act down for trial at such an early date was that if it was set on the 13th or auqie similar early date it would force the affi ant to dismiss the case.' Kelsey was acquitted at St. George some time ago of the murder of his wife, Lottie 1. Kelsey. He was charged with administering iKiisun to her.
