The senate last Saturday waxed Senator Smoot's bill to make sure the title of the public land states to lauds that an pranted to aid their public schools. In effect this bill tiipulate that school sections which may lie found to contain mineral after the date on which the time passes to the state, shall remain the iruperty of the atate or its assua, notwithstanding the discovery of mineral. And as to school lands found to rontain mineral before the the stateq title, attaches, the title of fedsurface ahall as to the state, the eral government retaining all mineral rights. The iMasaga by congress of this bill will remove the cloud on the title of many purchasers of school lands from the state of Utah. Utah a attorney general, Harvey II. Cluff, expresses the opinion that this bill would mean a big saving to the atate of Utah, inasmuch as it guarantees to the state title to all the lands to which the states title attached at statehood, and which were not known mineral lauds at that time. In other words his title from the state under present condi tiona apfiears to be always subject to attack. There are large areas of state lands in the coal fields of Carlton and Emery counties, for example, surveyed at time of statehood, to which the states title has since been questioned. This bill, if it passes the house, will vlarify that Btuation, and will mean much to the schools of Utah, since development of the coal area has demonstrated that they are underlain with coal. Similarly the state's right to grant oil leases on school sections will hr questioned, virtually, if the hill becomes law, inasmuch as there is practically no known oil land in the stnte at present. There are something like rases involving oil Innd twenty-fiv- e now before the federal land office, the contention being that they are mineral lands and therefore belong to the government, even though in school sections, and even though the application for a federal prospecting permit states n that the land are not known to oil in commercial quantitiea. Such contest would be very rare in the future, should the bill pass. Since practice now is that the possible mineral character of the land is investigated on the filing of the plat, it is assured that, should the hill become law, once the federal government has given patent to the state of Utah for the land, the atate retains title, regardless of what mineral discoveries may he made. The patent would, of course, be subject to attack for collnslion or fraud, but not because subsequently the lend proved to lie valuable for mineral purposes. The question of geological inference, which is involved in two coal land rases now before the secretary of the interior, from Utah, would liecome of little importance, should the hill introduced by Senator Smoot liecome law. The bill has previously lieen introduced at several sessions of Congress.
