The purpose of the Open House is to present the proposed design of a recreational trail to be constructed on the abandoned rail grade from 1-80 south to near the Echo Dam. The project also includes the construction of a pedestrian overpass using the existing historic train trestle. The open house aims to provide residents, the general public, and service providers with an opportunity to discuss the purpose and need for the project, view possible alternatives, and allow them to make comments on or address concerns about the project's scope and direction. Summit County wants the community to be involved in the project. The open house is a critical step in the environmental process for the project. The public comments from the open house will be considered by Summit County and UDOT when they determine advantages and disadvantages of the project and possible alternatives. The project is needed to provide a non-motorized trail to link between the existing rail trail that terminates near the Echo Dam and 1-80. This project is Phase 1 of a proposed project to connect the Echo Dam recreation area with the Town of Echo at some point in the future. This petition was filed by Mountain Regional Water Special Service District, one of the owners of the abutting property; and WHEREAS, Utah Code Ann. Section 72-3-108 provides the mechanism and process by which the public roads can be vacated; and WHEREAS, notice of the public hearing was published in a newspaper of general circulation in the county and posted in three public places at least once each week for four consecutive weeks prior to the hearing, and mailed to all owners of property abutting the road; WHEREAS, there appears from the record and the comments heard, to be good cause to vacate the section of road called Highway Project No. 147-B because there is no need for public access as another entrance exists to the Rockport State Park and the road has been gated; and WHEREAS, the vacation of this section of the road will not be detrimental to the general interests of the community nor materially affect the access enjoyed by the property owners. An agreement has been signed with one of the abutting property owners to allow a 20 foot access across the section of the road to be vacated; NOW THEREFORE, the Summit County Council acting as the Legislative Body of Summit County, State of Utah, or- dains as follows: Section 1. The Council hereby finds that the public will not be materially injured by the vacation of the section of Highway Project No. 147-B and there is good cause shown on the record to vacate the road because the road has been gated, there is no need for public access, and the historical public use of the road has been abandoned as a result of the new entrance into Rockport State Park. Section 2. The Council hereby finds that the road vacation as described above will not be detrimental to the general interests of the community nor will the access enjoyed by the property owners and the public be materially changed by the vacation. Section 3. Non-impairment of Private Rights. This road vacation has no legal effect and shall not impede or impair any private rights of access of third parties. Section 4. PUBLIC HEARING HELD BY THE HENEFER TOWN PLANNING COMMISSION The Henefer Town Planning Commission will hold a Public Hearing on April 12, 2010, at 7:00 p.m. The Public Hearing will be held at the Henefer Town Council Room located at 150 W Center Street. The purpose of the Public Hearing is to receive public input regarding a conditional use permit for Travis Rowser who is planning to build an office next to his home on East Henefer Road. The purpose of the meeting is to receive public input on the Amendment and Clarification of the Zoning Ordinance. The first five sections have been reviewed and clarified, including the definition of a Lot of Record. Comments on the proposed zone ordinance clarification can be made in person at the Public Hearing or submitted in writing to Henefer Town Inc., PO Box 112, Henefer, Utah 84033, prior to 4:30 on the day of the public hearing.
