Show MAY 9, 2008 If, within fifteen (15) days after the conclusion of the hearing, over fifty percent (50%) of the qualified voters of the territory proposed to be included within the SSD or the owners of over 50% of the assessed value of the taxable property included within the proposed SSD file written protest against the establishment of the proposed SSD or against the specified type of service to be provided within the SSD with the County Clerk, the Board is required by law, in the former instance, to abandon the proposed establishment of the SSD and, in the latter instance, to eliminate the type of service objected to from the resolution finally establishing the SSD. Any person who shall, at or any time prior to the date and time above-specified for the hearing, file a written protest with the County Clerk against the establishment of the SSD and who is a qualified voter residing within the proposed SSD or whose property has been included within the boundaries of the SSD notwithstanding such protest, may, within thirty (30) days after the adoption of the Resolution establishing the District, apply to the District Court of the Third Judicial District for a writ of review of the actions of the Board in establishing the SSD, only upon the grounds, however, that his/her property will not be benefited by the services authorized to be furnished by the SSD or that the proceedings taken in the establishment of the SSD have not been in compliance with law. NOTICE OF INTENTION TO ESTABLISH THE NORTH SUMMIT RECREATION SPECIAL SERVICE DISTRICT Notice is hereby given that on April 9, 2008, the Board of Commissioners of Summit County, Utah (the “Board”) adopted a Resolution declaring that the public health, convenience and necessity require the establishment of a Special Service District, to be called the “North Summit Recreation Special Service District” (hereinafter the “SSD”) for the purpose of providing recreational services within the boundaries of said SSD. Said Resolution also provides for a public hearing on the establishment of the SSD to be held at the Summit County Courthouse in Coalville, Utah at 2:00 pm on May 14, 2008. DESCRIPTION OF PROPOSED DISTRICT The SSD shall have boundaries coterminous with the North Summit School District, which boundaries are described as follows: North Summit School District Boundary All of Section 1 and the North 1/2 of the North 1/2 of Section 2, T 5 N, R 7 E, SLBM. PROPOSED SERVICES The SSD will be authorized to provide recreational services through the acquisition and/or construction of recreational facilities, systems or improvements to be located within the Service district, together with necessary appurtenances and equipment therefor. METHOD OF FINANCING Pursuant to the provisions of the Utah Special Service District Act, Utah Code Annotated, Sections 17A-2-1301 et. seq. (1953), as amended, and Article XI, Section 8 of the Utah Constitution, the SSD may annually impose fees and charges to pay for all or a part of the services to be provided by the SSD. It may also annually levy taxes upon all taxable property within the SSD, to provide the proposed services, and may issue bonds for the acquisition and construction of facilities, systems or improvements to provide said services, provided, however, that the levy to provide said services or to repay said bonds, must be authorized and approved by a majority of the qualified electors of the SSD at an election for that purpose. PUBLIC HEARING ON PROPOSED ESTABLISHMENT OF SPECIAL SERVICE DISTRICT The Board will hold a public hearing on the establishment of the proposed SSD at 2:00 pm on May 14, 2008 at the Summit County Courthouse in Coalville, Utah. Any interested person may protest the establishment of the proposed SSD or the furnishing of said services therein either orally at the hearing or in writing, at or at any time prior to the hearing. Written protests must be filed with the Summit County Clerk in Coalville, Utah, and may be withdrawn by the protestant at any time before the Board establishes or abandons the SSD. Any protest signed on behalf of a corporation owning property in the proposed SSD shall be sufficient if it is signed by the president, vice president, or any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing, the Board will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Board may continue the hearing from time to time. After conclusion of the hearing, the Board shall adopt a resolution either establishing the SSD or determining that the establishment of the SSD should be abandoned, or may, in its discretion, reduce the boundaries of the proposed SSD and establish the SSD by resolution, as modified.
