Provo, Jan. 4 Herald Special When 'Blacky" Lewis took the stand as a witness in his own behalf it developed that he had served about two years in the state penitentiary for robbing a car In Salt Lake City in a similar way to that charged against him in the present case, ne also spent some time In the Salt Lake county jail for stealing. In the evidence it turned out that besides stealing tomatoes and peanuts from the Rio Grande Western car at Springville, ''Blacky" had stolen a box of tobacco, a saddle, an overcoat imd ot her small articles. In the cross-examination the defendant defend-ant hung hi's head and very reluctantly reluctant-ly answered questions, which revealed a very bad record of crime. His photograph pho-tograph was in the hands' of the pros ecuting attorney, and when shown to the prisoner he said, "yes, that's me, and 1 guess vou have got my record along with it." A verdict of guilty was found by the jury, and sentence will be passed Thursday morning at 10 o'clock. SHEPAKD ACQUITTED. William Shepard, who is a smoothfaced, smooth-faced, bright Wiring younz man. came to trial today charged with burglarizing the Oregon Short Line depot in Provo on the 27th day of last year. It is claimed that this defendant defend-ant stole 12 pairs of ladies' and 12 pairs of gent's shoes on the 27th of October last. Officer ltaleigh of Salt Lake testified to having arrested Shepard and found the boots and shoes in his possession. Defendant had disposed of some of the goods by peddling them in Salt Lake. The prosecution could not produ. e testimony to show that the defend ant was in the vicinity of the place where the crime was committed, and a verdict of not guilty was returned at the request of the prosecuting attorney. Frank Smith, a pal of Shepard, who was arrested on the same charge, was given his freedom by reason of the evidence being somewhat meagre. Maintain the Health.
