SUSC student is . held on rape charge An SUSC athlete faces a preliminary hearing tomorrow in Ninth Circuit Court on a charge of second degree felony rape. Nicholas Kimaiyo, 25, a foreign student from Kenya, was arrested and charged in connection with the alleged crime by Cedar City Police Sept. 26. A police spokesman said the victim was allegedly raped following a Saturday night dance at the college. The victim, an acquaintance of Kimaiyo, called police immediately following the incident. The crime allegedly took place in a room in the College View Apartments where the suspect lives. The victim told police that she was invited to the suspects room following the dance where he forced himself upon her. She said she resisted, but he overpowered her. Steve Sharp, manager of the apartment complex, would be a likely witness if the case were to go to trial. He and his wife occupy the bedroom immediately below the room where the alleged rape occurred. We didnt hear anything going on up there, Sharp told The Thunderbird. "We were asleep when the girl claims it happened, but the walls are thin and I feel we would have heard a struggle going on in a room above our room. Kimaiyo was arraigned on the rape charge the same day and was ordered held in the Iron County Jail in lieu of $10,000 bond. Kimaiyo is scheduled to appear before Ninth Circuit Court Judge Christian Ronnow for a hearing Tuesday. Even if these precautions are carefully followed a woman may still find herself in a potential rape situation. Hoyt suggests that keeping calm and doing a lot of talking is the best course to follow. On several cases, women were able to talk their way out of this. Outsmart him, break away into a building or to someone for help. Mild physical resistance, to the point where you dont get hurt, may also prove effective. Dont hesitate when you see someone suspicious; we dont mind being called. Rape It Can Happen To You.. .discusses myths and facts about rape, self protection and what to do if you are in a potential rape situation. These can be obtained at the Student Health Center. Kay Messerly, nurse and director of the Student Health Center, advises what measures a victim of rape should take after an attack. First, go to the nearest medical facility as soon as possible, where the medical personnel will check clothing and the vagina for sperm, administer a shot of penicillin for V.D. and an injection of DES to treat possible pregnancy. She shouldnt alter her body one bit; if she has her blouse torn, that's how she should go, says Messerly. Also, if possible, the victim should not urinate or shower before being examined by medical personnel. Although the physical effects of rape may not be long lasting, the emotional effects can take far longer to heal. Rape is an invasion of your innermost privacy. Someone else is in control of your body and you aren't, Messerly says; adding that counseling with a trained counselor can help a victim deal with the emotional strain. Gary Dunford, director of counseling, explains that victims of rape often experience tremendous feelings of anger, frustration and guilt. Its really a confusing period for them, Dunford says. one-on-o- Rape is an invasion of your innermost privacy. Someone else is in control of your body and you arent. Often she will question whether the rape was her fault or whether there was something she could have done to get out of the situation. The victim is not the only one forced to deal with the stress of rape. Her family and those closest to her also suffer. When the victim can look back at the experience and feel pity for the person who abused them or say to herself, Even though this was a bad experience, I can use it in a positive way by helping someone else who has been hurt this way, it is a sign that she has surmounted the emotional impact of the rape. But, says Dunford, it may take a long time before she reaches this point. Fortunately, we live in an area where these things dont happen often, but we need to be aware that they could. |
