Conversely, it has come to the attention of the Southern Utah News that NufTer, who is from St. George, had not originally sent letters asking local attorneys for a bid. Local attorneys found out about the job only by accident the day the bid3 were to be opened and the contract awarded. City Manager Keith McAllister was questioned about the move and he put off opening the bids until both local attorneys could be contacted and a legal notice put into the paper. Mayor Ripper announced the lawsuit filed in Federal Court by Brandt Child against the City w hich alleged Childs civil rights had been violated was dismissed with prejudice." Ripper explained with prejudice" means Child can not file the same lawsuit again. The Citys liability insurance has a $5,000 deductible for each case and Ripper said the total bill for the City to defend itself was $3,555. Crosby said he had been working on a solution to the noise created at the Kanab Texaco by truckers who keep their engines running to keep warm at night Crosby said neighbors had been complaining about the noise and Lawrence Reese, owner of the gas station, was anxious to solve the problem. Crosby suggested the City hang a transformer and install an electric meter near where the trucks park. He said Reese could rent the truckers small electric heaters which would allow the truckers to turn off their motors and cover the cost of the watch a video about the program that explained new technology that allows wood to last two or three times" longer than the concrete and steel used to build most bridges today. She explained that grants are available for the bridges. The Federal government will donate up to $60,000 or 50 percent of the cost, dependent on which is smaller. The Council wants to investigate the possibilities further and asked their bridge engineer, Tony Thompson from Leslie and Associates, to contact the Forest Service. The City advertised for a public defender and seven attorneys, including five from St. George entered bids. Local attorney Van Mackelprang was awarded the contract. One attorney bid lower than Mackelprang, but NufTer electricity.
